Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

receiving such a perm it, I will be responsible for the removal of remnants of all or
pocti y damaged sandbags, and that the sandbags may remain in place for
two ve years after the date of permit approval. Once the temporary erosion

removal of the house, the bags must be removed within 30 days.
I also understand that the removal of the sandbags shall not be required if they are
covered by dunes with vegetation sufficient to be considered stable and natural two

Enclosed you will find a $400.00 check made payable to Coastal Management. This
check is to cover the cost of the sandbag permit issued for the Gallagher property located
at 11201 Inlet Drive in Emerald Isle.
I believe that the installation of the sandbags began last week, none too soon as I
understand. I will follow-up with Cecil Carter to ensure that the project is complete.
Thank you for your support and consideration in the issuance of this permit. I know that
the sandbags will protect the value and integrity of our property as they will assist in
keeping the erosion at bay. Again, thank you!

Jim, Ted -
Please find attached two graphics illustrating the relative change in elevations at the toe of the dune
escarpment, the low "depression" behind the dunes, and the homes on Inlet Drive. The two properties
that we are now seeking sandbags for are Gallagher (11117 Inlet Drive, and directly east of Murphrey)
and Townsend (11115 Inlet Drive, and directly east of Gallagher).
As you will note, the low "depression" between the dune and the homes is about .53 feet lower than the
toe of the dune escarpment at Gallagher's home, and .65 ft. lower than the toe of the dune escarpment
at Townsend's home. The foundations of the homes themselves are only approx 1.04 ft.
(Gallagher) and 2.36 ft. (Townsend) higher than the toe of the dune escarpment. The height of the
remaining dune at Gallagher's home is approximately 10 ft. at the escarpment, and approximately 7 ft. at
the Townsend escarpment. The distance between the dune escarpment and the low depression is
approximately 30 - 40 ft.
This area has suffered a total dune line recession of approximately 22 ft. in the past 23 days, based on
the measurement of the distance from the most landward sandbag at the eastern boundary of the
Murphrey home back to the dune escarpment. As I noted to Jim when we visited the site last week,
there does not appear to be any significant, continuing erosion to the dunes located east of the
Townsend home. I truly believe that Gallagher and Townsend will be the only additional homes that will
need sandbags in this area, but that will obviously be up to Mother Nature to decide in the coming
weeks and months. As noted to Jim last week, we continue to see accretion in the areas east of the
Townsend home as the protruding oceanfront "spit" continues its migration from east to west in this
area. The beach in front of the Channel Drive public beach access, located approximately 550 ft east of
the Townsend home, has accreted significantly (on the order of 100 - 150 ft.) since early summer. We
remain confident that the erosion problems in this area are short-term, and that the long-term prognosis
for natural stabilization is good.
have received signed forms from Gallagher and Townsend that authorize me to act as their agent to
secure sandbag permits for them. The Gallaghers and Townsends are understandably concerned, and
would like to begin sandbag placement as soon as possible. I truly believe that the sandbags are
justified for these two homes based on the CAMA rules for sandbags in rapid erosion / flat beach profile
areas.
Please let me know if you will issue a permit soon so that we can begin to mobilize the sandbag
contractor. Also, please let me know if you need anything else from the Town or the property owners,
and we will do our best to provide any information needed.
Thanks again for your assistance on this matter, and especially for your personal attention and
accessibility. I greatly appreciate the attention and accessibility.

NOTE: The information for Gallagher was prepared by a licensed surveyor on October 8. The
information for Townsend was prepared by myself and the Town's Public Works Director on October 9
(using the same methodology used for Murphrey last month). As you will note, the results are similar for

Jim,
Thank you for taking time out of your busy schedule to visit "The Point" last week to look at the erosion. I know
you; Ted and Frank are working hard on our behalf.
It is greatly appreciated.
I thought everyone would be interested in my observations this past Saturday, October 6th
The bad news, the erosion at our place since our sandbags were put in September 13th, 23 days ago,
measures a 19 feet loss of the highest dune west behind our sand bags and 25 feet north toward our house.
Susan Gallagher, our neighbor, to the east has experienced a 25 foot loss of her last remaining dune in the
same time frame.
The survey information Frank will be forwarding to you indicates there is only six (6) inches difference between
the low point behind the dune and the toe of the dune on the ocean side.
Obviously, this is very alarming since the erosion rate has nearly doubled in the last 30 days. For the last year it
has been 16 feet per month, prorated this month it would be an astounding 31 feet. Given the amount of time it
takes to arrange an official visit to the site, the time necessary to issue a permit, the time to arrange for the
sandbags to be installed and the contractor's availability, we hope this survey will be what you need to support
your decision to issue a permit as soon as possible. We have the contractor waiting to hear from and really
need for him to start immediately before he gets involved in another project.
Now, the good news! In the last 20 days "The point" east of us has moved west approximately 200 feet! This
is due to the little ocean channel in between us and the outer bar closing down at the ocean and allowing the
bar to begin moving to the west and toward the shore!
This is what we have been waiting all year to happen!

that cares and is trying help!
