Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. Dear Mr. Waters: This letter is in response to your objection as an adjacent riparian property owner to a permit request from Albert and Betty Eure, for the construction of a pier extending off an existing elevated walkway over wetlands at Lot 44D Eagle Nest Court, Sutton's Landing Subdivision, Perquimans County. Kimberly Hedrick, of the Division of Coastal Management staff, was recently on site to evaluate the permit applicant's request. The permit applicant has requested a permit to construct a 200-foot long by 6-foot wide pier to extend from an existing elevated walkway over wetlands into Perquimans River. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H .1200. You have notified the Division of Coastal Management of your objections to this proposed development by letter and expressed that your objection was based upon an increase of boat traffic and noise, and adverse effect on your property value. Kimberly Hedrick has reviewed your objection, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. The above referenced Subchapter 7H.1205(b) states, "Piers, docks, and boat houses shall not extend beyond the established pier length along the same shoreline for similar use..." The proposed 200-foot long by 6-foot wide pier off Lot 44D Eagle Nest Court will not extend beyond the existing Sutton's Landing community pier along the same shoreline to the north. Subchapter 7H.1204(a) states, "...Piers designed to provide docking space for more than two boats shall, because of their greater potential for adverse impacts, be reviewed through the major permitting process and, therefore, are not authorized by this general permit." Therefore, the Division of Coastal Management issued General Permit No. A46846 on February 1, 2007 (copy attached) for the proposed development. If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division of Coastal Management within 20 days of the permit issuance date.
