August 1, 2007 John Gilbert 2 20F Doris Gilbert p� 4023 North Lee highway I� Orehead City DCM Fairfield, Virginia 24435 RE: Objections to the Issuance of General Permit to Construct a Pier Extension, Platform and Boatlift at 225 Broadbay Drive, Colington Harbour, Dare County, North Carolina Dear Mr. and Mrs. Gilbert: This letter is in reference to your correspondence received on May 15, 2007 and July 24, 2007, objecting as an adjacent riparian property owner to a request from Michael Connell to construct a wooden pier extension, platform and boatlift on a man-made canal in Colington Harbour. Lynn Mathis of the Division of Coastal Management staff was recently on site and reviewed the proposal and found it consistent with T15A, Section 07H .1 100: General Permit for Construction of Piers: Docks: and Boat Houses in Estuarine and Public Trust Waters and Ocean Hazard Areas (Enclosed). The Division of Coastal Management has given your objections careful consideration and has determined that the project, as proposed, is consistent with the appropriate rules and regulations and that all prerequisite requirements have been met. The Division issued General Permit #48721 A on July 31, 2007, to Mr. Connell (See Enclosed Permit). The placement of the structure will comply with the Division's standards or Mr. Connell will be required to correct or remove the structure. If you wish to request an appeal of this decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within twenty (20) days of the permit decision.
