The proposed project to be located and constructed as described
above is hereby certified as exempt from the CAMA permit re-
quirement pursuant to 15 NCAC 7K .0203. This exemption to
CAMA permit requirements does not alleviate the necessity of
your obtaining any other State, Federal, or Local authorization.
This ccrtification of exemption from requiring a CAMA permit is
valid for 90 days from the date of issuance. Following expiration,
a re-examination of the project and project site may be necessary
to continue this certification.

Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

Dear Mr. Cox,
I am writing to you with regard to your request for a pier permit for Lot 16, BIair Point, in
Carteret County. Included with your request was a check to the Department in the amount
of $50.00. The permit is requested for development within the Estuarine Shoreline, Coastal
Wetlands, Estuarine Waters, and Public Trust Area, all Areas of Environmental Concern.
The appropriate vehicle for your request is the General Permit process.
Specifically, your platwork indicates that you plan to construct a pier 397' in length, with
approximately 58' elevated over Section 404 Wetlands, approximately 57' elevated over
coastal marsh, and approximately 282' extending into the open body of water of the Newport
River. According to your submittal, the proposed pier will extend approximately 339' from
the normal high water line, ending with a 46' x 8' dock, to supply mooring for two (2)
vessels. The project is to terminate approximately 30' from the edge of the channel in -5' of
water at normal low water.
In accordance with T15A: 07H .1205(b), "Piers, docks, and boat houses shall not extend
beyond the established pier length along the same shoreline for similar use. This restriction
shall not apply to piers 100' or less in length...... The length of piers shall be measured from
the waterward edge of any wetlands that border the water body." This rule is expressed again
in the General Use Standards, T 15A: 07H .0208(b)(6)(J)(i), and consequently, the Major
Permit process allows no further flexibility to this restriction.
Currently, the Iongest pier along this shoreline for similar use extends into the body of water
approximately 192'. Your proposal would exceed this length by 90', and as such would
contravene state use standards.
Based on the preceding information and the submitted proposal, the Division must deny your
request for authorization of this project. This denial is made pursuant to N.C.G.S. 113A-
120(a)(8) which requires permit denial for projects inconsistent with the state guidelines for
Areas of Environmental Concern or the local land use plan. Should you wish to appeal this
decision to an Administrative Law Judge, or request a variance from the rule from the
