This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

This is to advise you that I have been provided a copy of Capt. Sinbad's plan of attack for
the upcoming Blackbeard's Bounty Festival. I discussed the pyrotechnics and procedures
that will be used with Capt. Sinbad today; based upon what I was told I see no problem
with the attack if:
1. EOD personnel are in charge of the pyrotechnics.
2. Cellular phones are on hand at both the fort and on the participating vessels.
3. All aspects of the plan are carried out as outlined in the attack plan.

INDEMNIFICATION AGREEMENT
CARTERET COUNTY
THIS INDEMNIFICATION AGREEMENT is made this %T day of Oc�— /
1998, by CAPTAIN HORATIO SINBAD, ("Indemnitor"), and SUGARLOAF PROPERTIES, INC.,
a North Carolina corporation ("Indemnitee");
WHEREAS, the Indemnitor has obtained permission from Indemnitee to secure a vessel
to certain real estate in Carteret County, North Carolina, owned by the Indemnitee and commonly
referred to as Sugarloaf Island, for the purpose of staging an historical re-enactment; and
WHEREAS, as a condition of such permission Indemnitee has requested the Indemnitor
to warrant or guarantee the performance of certain acts and the taking of certain precautions in
connection with the use of the property;
NOW, THEREFORE, the Indemnitor- agrees as follows:
1. That he will assume full responsibility for the obtaining of all necessary
governmental permits to conduct the proposed historical re-enactment, from the County of
Carteret, the Town of Morehead City, or any other governmental entity having any jurisdiction
over the proposed activities.
2. That he will cooperate with the fire department or the Town of Morehead City to
assure that protection is on hand to guard against any fire hazard to the vegetation on the
property.
3. That if necessary the property will be cleaned up after the event, and any evidence
of the utilization of the property will be removed.
IN WITNESS WHEREOF, the undersigned has set his hand and seal, the day and year

Blackbeard's Festival Attack Plan
1. Meka II, carrying the notorious Blackbeard and a crew
of cutthroats chases "Flotilla" down channel firing as they
go.
2. Meka II fires on Fort Sugarloaf. Fort returns fire.
3. "Merchant Ship opens fire". Pirate ship returns fire.
4. Pirate ship tacks back and forth in front of fort
firing, destroying the Merchant Ship and heavily damaging
the fort.
5. Galley strikes out and follows marshes firing on fort.
Fort returns fire. Galley and Pirate ship pound fort into
submission.
6. Galley boards fort planting Blackbeard's flag
7. Pirate ship breaks off and anchors mid -channel.
8. Galley joins pirate ship, Blackbeard transfers to
galley, galley brings blackbeard ashore to the waiting
crowd.
NOTES
The charges in the water are black powder in a floating
mortar to simulate cannon balls hitting water. Those in the
fort, back in the marshes and mud flats are black powder
with a powder special effects enhancer to simulate cannon
balls hitting and throwing up debris.
The charges will be set off electrically with squib's
with a control board at the fort and aboard the merchant
ship by designated participating EOD team members.
There will be no actually burning of structures. All
damages will be simulated with small explosives, enhancers,
and smoke generators.
Choreographed shots will be commanded by the chief EOD.
All sources of gunfire and pyrotechnics will be in
communication by radio.
A doctor will be aboard the MEKA II as ships pirate
doctor. A EMT and fire fighter will be in the fort.
The Coast Guard will do picket duty with two boats, one
equipped with a fire monitor. Along with two Coast Guard
Aux. craft, the Coast Guard will keep the stage area clear
of other non -participating craft.
A crash/clean-up boat will be standing by.
The environmental impact will be minimal, less than a
fireworks show. Clean-up and stand down will be initiated
following the battle.
The fort and merchant ship will be constructed at
Russell Yachts and transported by crane barge to the stage
site. After the battle the fort and ship will be removed
and stored for future use.
Over fifty pirates, planners, builders, and donors will
be participating to bring this attack to Morehead City
The attack will last approximately 30-40 minutes.
As far as I know there are no permits necessary for
this type of outdoor theatrics and simulation.
I hold a BATF high explosive purchase and user license.
