Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

Dear Mr. Welch and Ms. Smith:
Through coordination with Mr. James Mercer of the North
Carolina Division of Coastal Management, we have learned of your
State authorization to construct and backfill bulkheads on Brices
Creek, New Bern, Craven County, North Carolina.
On April 1, 1988, we renewed general permit No. SAWC078-N-000-
0080 (copy enclosed) that authorizes the maintenance, repair,
construction, and backfill of bulkheads and riprap material
structures along eroding shorelines in navigable waters and waters
of the United States in the State of North Carolina.
Your proposed work is authorized if you can comply with all
permit conditions and the bulkhead alignments indicated by
Mr. Mercer on September 124, 1988. Please read the enclosed
permit to prevent an unintentional violation of Federal law.
