Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Hazel and Richard:
I am in receipt of your application for a new seawall on the property conveyed to you by Cape
Carterett, Inc. on August 14, 1979 in Book 433, Page 227. As a reminder to you, my father in
the deed to you from his corporation reserved a 6 foot wide easement for pedestrian travel for
purposes of access to the basin or creek adjacent to your property. This easement included the
right to place docks or boats and other mooring areas in the riparian areas adjacent to the
shoreline from Neptune Drive. I have now been granted all rights in the easement by deed
recorded in Book 1083, Page 5, Carteret County Registry.
My family and I have known you for many years and my consent to the issuance of a permit to
construct the seawall is not a release or relinquishment of any rights under the easement.
Likewise your construction of a seawall, docks, or piers within the riparian areas adjacent to the
easement is not a waiver of my rights to use the docks, piers, or improvements or to force you or
subsequent owners of the same to remove or relocate the docks, piers, or improvements at some
time in the future. These factors should be considered as you proceed with construction as I am
granting consent to the issuance of the permits at your personal request and due to our close
relationship.
