Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The current pipe is failing and needs to be replaced to ensure safe public travel. The existing pipe 1 @ 30' x 18" RCP will be replaced with the proposed pipe 1 @ 40' x 30" CAP. The road shoulder at the inlet and outlet of the pipe will be stabilized with class'S" rip -rap, The Division of Coastal Management considers the project area to be within an AEC that requires authorization for the pipe replacement. Included with this request are the MP-1, MP-2, MP-5 forms, location map, landowner notices, and permit drawings depicting the proposed work WBS element # is 1.102711.
