Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

I have talked to you before concerning the Hill's request for a permit for a dock
adjacent to the Taylor property. Enclosed you will find their request to waive the set
back requirements. As I stated to you in 2005 when we spoke on the phone, my concerns
are ownership - when and how they acquired this property. By looking at the Deed and
previous Deeds, the chain of ownership is not clear.
As you are aware, the town of Beaufort has had problems with ownership of water front
property at the end of a street. The proposed location of this dock is at the end of Gerald
Street in Beaufort. The four people that claim ownership of the property in question does
not own any property in the general area posing a parking issue. Flow of traffic on Front
and Gerald street could become greatly jeopardized.

In response to your letter received April 13, 2008,1 do not wish to waive the set back
requirements at this time. Not ' g has changed since your letter of July 25, 2005. I have
received no documentation to prove or clarify the ownership of adjacent property in
question. My reasons for not waiving the set back requirements remain the same and are
