Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
Iandowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistent with the North Carolina Coastal Management Program.

Dear Sirs Or Madams,
My neighbor Dr. Dan Whitely is proposing to extend his docking facilities future out into Hoop
Pole Creek basin. I am opposed to such an extension. It would impair my lauching and docking
my boat. I have to curve around his dock now and if he extends his dock further out it will make
it almost impossible for me to come into my dock at a reasonable angle, therefore I am opposed
to the extension of his dock.

This correspondence is in reference to your September 08, 2009 letter of objection to the reconfiguration of the
existing docking system proposed by Dr. Dan Whitley, within Hoop Pole Creek, located at 121 Hoop Pole
Drive in Atlantic Beach, Carteret County, NC.
The DCM reviewed the application along with the pertinent rules of the Coastal Resources Commission in
conjunction with your objections. We have determined that the project, reduced in length by 4' so as not to
exceed the existing dock footprint, is consistent with the Commission's rules. Therefore, the DCM issued
CAMA General Permit #54614 to Daniel Whitley, on September 15, 2009, authorizing the reconfiguration of
the docking system within its original footprint.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request with the Director of the
Division of Coastal Management, Mr. James Gregson, Department of Environment and Natural Resources,
within 20 days of the permit decision. A copy must also be sent to the Attorney General's Office,
Environmental Division. If you wish to appeal, please contact me and I can forward you the pertinent forms.
