Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

This correspondence is in reference to your January 22, 2010 letter of objection to the floating dock addition to
the docking system proposed by Gerald and Donna Valentine, within a tributary to Spooner's Creek, located at
5238 Webb Court in Morehead City, Carteret County, NC.
The DCM reviewed the application along with the pertinent rules of the Coastal Resources Commission in
conjunction with your objections. We have determined that the project is consistent with the Commission's
rules. Therefore, the DCM issued CAMA General Permit #55232 to Gerald and Donna Valentine on January
28, 2010, authorizing the addition of a 6' x 18' floating dock to the existing docking system.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request with the Director of the
Division of Coastal Management, Mr. James Gregson, Department of Environment and Natural Resources,
within 20 days of the permit decision. A copy must also be sent to the Attorney General's Office,
Environmental Division. If you wish to appeal, please contact me and I can forward you the pertinent fornis. If

Request for floating dock at Spooner's Creek
Dear Ms. Styron:
This letter is written at your suggestion following our brief meeting today at your
off ice.
I expect Mr. Valentine to submit an Adjacent Riparian Property Owner Statement for building a
floating dock. I did sign the statement yesterday, January 21, 2010, however I now have concerns
about the proposed dock after giving the proposal further consideration.
1. My boat is located on a lift only 30 feet away from the proposed dock. My boat is 22 feet
long including the engine. It will definitely make ingress and egress to my boat lift more
difficult once the dock is constructed. Furthermore, if Mr. Valentine has his boat tied off
beside the new dock I seriously doubt that I can maneuver my boat on or off of my boat
lift. My boat lift is actually much closer to the proposed dock than is shown in the proposec
sketch.
2. The maneuverability problem is further compounded if I were to acquire a longer boat.
I am not objecting to the construction of the floating dock but I do not think it should be built in
the proposed location and within 30 feet of my boat lift. I would be a simple matter to move the
dock further to the right away from the travel zone. I am requesting that you give this your
consideration when you make your site inspection.
