Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

The "Taylors Creek Subdivision U"ted Common Area" owners are applying for a maintenance dredging permit for
Cowpen Creek downstream of Lennoxville Road in Beaufort- Hcather Styran of DENR's Coastal Management
Office in Morehead asked that we get a "Adjacent Riparian Property Owner Statement" form the Department;
although the dredging we are proposing is almost 200` downstream of the NCDOT right-of-way.
I'm attaching a form, drawing, and aerial shoving the area for your consideration. If you concur with our proposal,
please sign it and fax the form to Ms. Styron at 247-3330. She asked that we include reference to Cowpen Creek
Dredging in the transmittal. (,
While discussing this with Aaron Everett this afternoon, I told him that the two corrugated metal culverts under
Lennoxville Road are almost completely filled with oysters and that there is a minor depression in the road above one
of the culverts. He asked that I include this in this note so you quid forward it to David Livingston for his
investigation.

We've received supporting votes from Phil Whitley, Sue Frye and myself. When yours gets here we'll
have the required majority to levy the assessment and can proceed.
In the mean time, I'm proceeding with the CAMA permit. As an adjacent property owner, we need you
to sign an "Adjacent Riparian Property Owner Statement" and fax it to Heather Styron at DENR's
Coastal Management office in Morehead at 252-247-3330. She asked that we include her name and
"Cowpen Creek Dredging" on a transmittal cover.

Heather,
We would like to modify the permit to allow dredging up to the maximum 999 CY allowable under the
maintenance dredging guidelines.
You calculated 759 CY based on the drawing and soundings I submitted. This allows an additional 240 CY that
could be permitted.
I had previously measured the total dredge area at 1,294 SY using my CADD program.
If the maximum dredge depth is adjusted to accomodate this additional 240 CY, it will increase from the 3.0'
below normal low water to 3.56'. The CAMA Major Permit issued in 1985 for the initial excavation was for a
depth of 5' below mean low water.
This is to request you amend the permit (No. 54158) to a maximum depth of 3.6' below normal low water and a
maximum of 999 CY.
