violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistent with the North Carolina Coastal Management Program.

Emerald Isle, NC 28594
Dear Sir/Madam:
We represent Christopher T. Aul and Julie T. Aul who are
adjacent property owners in the above. On or about July 22,
2009 on behalf of the Auls, we filed an objection to a previous
permit request that would have brought the Swains' pier across
the Aul property and into the Auls' riparian waters.
Within the last 10 days the Auls have received a new proposed
pier design from the Swains. A copy is attached.
We believe this new proposal is confined to the Swains' lot (Lot
14, Pelican Point Subdivision, Emerald Isle, NC) and the
riparian area south of the lot into Piney Creek. We attach a
copy of a previous survey of the Swain property for your
confirmation. The new design appears to us to be in the same
location as the Swain pier built in approximately 1998 according
to a CAMA permit, which we believe is Permit No. 018746-C.
The Auls have no objection to this most recent proposal
conditioned on the following:

1. The Swains'
location as
Permit;
pier will be located in substantially the same
their previous pier according to their 1998 CAMA
2. The pier will remain within the confines of Lot 14, Pelican
Point Subdivision, Emerald Isle, NC and the riparian area
south of said lot extending into Piney Creek; and
3. The Auls are not waiving CAMA setbacks; however as configured
on the sketch of proposed new pier, most likely the pier does
not encroach into any riparian area that is claimed by the
Auls.
