Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Sir of Madam:
I am one of three owners of the property at 5 Lagoon Drive,
Wrightsville Beach, NC. I received a notice from Peter Starek of an
application for a CAMA permit to construct a dock at 7 Lagoon Drive,
Wrightsville Beach, NC. I do not believe the other owners received a
notice.
I have enclosed an Adjacent Riparian Property Owners Statement
form in which I have indicated objection to the proposal and no waiver of
the 15 foot setback requirement. Because I have been out of town, I did
not actually see the notice until yesterday and have not had the
opportunity to speak to the applicants. I believe that I will be able to
resolve possible issues with the applicants so that we can withdraw any
objection.
The basis for objection to the plan as currently proposed is
that it would not meet the 15 foot riparian line setback established in
the CRC Rules if the riparian line between the applicants property and our
property begins at the high water line at the applicants southern corner
as the high water line existed at the time of the subdivision of the
property as shown on the subdivision map recorded in Map Book 3 at Page 75
in 1940. We are concerned that we will lose riparian area it the riparian
line as proposed by the applicants is used for the northern boundary of
our lot and the riparian line using the 1940 shore line is used for the
riparian boundary on the south end of our lot. We hope to resolve this by
a conditional agreement with the applicants that they will grant a waiver
of the riparian setback if a different methodology is required by the
regulatory authorities or courts for our southern riparian line. I
request that you delay the issuance of any permit until such time as I and
the other owners of 5 Lagoon Drive can resolve this issue with the
applicants.
