This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. L.,; June 25, 2002 To: Tracy Wheeler From Walt Strand &r Fred Schubert Whitaker Creek Yacht Owners Association Re: East Dock Seawall Permit Dear Tracy, Thanks so much for your time yesterday in trying to explain the situation about the sea wall from your point of view. I would like to bring this up in writing so that all parties can have the benefit of your input and we can use this information in resolving the interests of both parties in the construction of the new sea wall. We do feel that along with Mr_ Bysheim that eventually this entire peninsula should be bulk headed in order to save both of our mutual interest for the future. We would like to further discuss this at a later date with all parties present. Again, so that we can get the benefit of your experience about our future and what CAMA can and can't do so that we are all talking from the same page_ This is the only way that we can secure the future of the marina and the Whittaker Creek Yacht Owners Associations properties and reparian rights. Regarding our conversation yesterday. The WCYOA interest in the sea wall is to maintain our reparian rights to our property. This means a strip of land along the inside of the sea wall that gives us the right to maintain our reparian rights. The other issue is to insure that Mr. Bysheim maintains his property to the marina to assure the future of the marina, gas docks, etc. So this is mutually beneficial to both of us. We are concerned that some of the WCYOA property has eroded and left us with no right of way along the shore to maintain our reparian rights. >From the WCYOA stand point, we will have no further interest in the sea wall other than to protect our interest in the boat slips. Mr. Bysheim has agreed to maintain this sea wall and have full use of this wall. However, we will pay half the cost of constructing this sea wall. Our concern is, as we talked about yesterday, that in some instances our property has eroded away. The WCYOA Board of Directors, has signed a permit to allow the construction of a sea wall- We feel that any less then what was described in our permit would not be in our best interest. We would appreciate you going ahead and staking out the property as you see fit, trying to save as much of the WCYOA right of way property as possible. If you could do this without signing the permit for construction so that we all have the chance over the fourth of July weekend to meet with Mr. Bysheim and come to a mutual agreement that would benefit us both. Mr. Bysheim stated in our last meeting on June 24th, 2002, that he might 06/25/2002 07:47 FAX 3368556066 IANDD IM 002 : r make an amendment to our present by-laws that would allow enough property even if it is only an inch (or whatever is necessary to assure our reparian rights). It would be wonderful if this could be settled and we would have no issue about where the sea wall would be located. Again, from the WCYOA point of view, and as you stated to me in our conversation, maintaining our reparian rights is absolutely necessary. In summary, would you go ahead and proceed with staking out the boundary line but not signing and issuing a permit for the construction, of the sea wall until the WCYOA Board of Directors can meet with Mr. Bysheim to discuss the results of your findings. We plan to meet with Mr. Bysheim within the next two weeks.
