Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Ross Jr., secretary May 3, 2002 Mr. Will Saunders t4Ai 0 7 2o02 494 Camp Perry Road Hertford, North Carolina 27944 Dear Mr. Saunders: This letter is in reference to your correspondence dated March 19, 2002 objecting as an adjacent riparian property owner to Mr. Tildon Whitehurst's request to place riprap and replace a pipe on his property located at #2 Camp Perry Road (SR 1317), Perquimans County and on the Perquimans River. I have reviewed your objection to Mr. Whitehurst using the access road because the previous owner, Mr. Houseknecht, had not contributed to the road maintenance for 23 years. The access road is not located within a Designated Area of Environmental Concern and the nature of your request is not regulated by the Coastal Area Management Act. Therefore, the Division of Coastal Management has given your objection carefiil consideration and has determined that the project as proposed is consistent with the appropriate rules and regulations and that all pre -requisite requirements have been met. Consequently, the Division issued a general permit (copy attached) on 3 May 2002 to Mr. Tildon Whitehurst for the placement of riprap and to replace a pipe on his property. If you wish to appeal this permit decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within 20 days of the permit decision.
