She was frustrated that she hadn't heard anything about her pier request. Evidently, she was aware of the SAV issue because she said she couldn't find anything on our Web site that prohibited piers from going over them. I didn't tell her anything except to say that I would mentioned to you that she came by and have you call her. I asked Brad what he was doing with piers being located over SAV's and he said he was issuing permits and notifying Trish Murphy with DMF so that they could monitor the site. This helped refresh my memory as to what the ultimate outcome of the Bailey permit which DMF had originally recommended for denial. DMF withdrew their denial because of lack of concrete evidence over the degree of impacts. To help DMF begin their research over the impacts of pier construction and use we agreed to let DMF know of pending pier projects being located over SAVs so they could monitor. Brad.has been doing this. I would recommend that unless their is some other issue, we should issue the GP and let Trish know. If there is some other reason not to issue a GP other than the SAVs, then that's okay too. I believe Lampe has a different issue and that would be potential impacts to navigation. It was not the issue of piers over SAV's but the issue of the docking facility ending in SAVs. This is what Ron Sechler had said he could not recommend for under a major permit for Lampe. The reason Crystal hasn't heard is because I have been dealing with her contractor, Buddy Baysden, who was told on Friday that we were going to require a major permit, and said he was going to act as her agent in the process. I didn't realize that Buddy would not communicate with his client. In fact, Crystal had told me to speak with him rather than her because she would be going out of town for the week. The memo from P3 addresses the effects of piers over SAV's, not the actual dock. I asked Brad if in fact he has written any GP's for docking facilities terminating in SAVs, and he said that he has not knowingly done so, and if he had one that terminated in SAV, he would raise the question for obvious reasons. Do you want me to call Buddy Baysden back and tell him we will not require the major after all? I really don't care one way or another except for the fact that Lampe is down the block, and this issue has been the impediment to his proceeding with his application, since he has been told directly by NMFS that they would have to recommend against the actual dock being in the SAVs, and any extra length to get over the resource would conflict with other rules. The objection to the project we entered into the record explained the concerns we have about the immediate and cumulative impacts of this and other projects being built across beds of SAV. Although we feel our concerns are valid, we have little empirical information on which to base this denial request; therefore, our objection is being withdrawn. You should place appropriate conditions on the permit to minimize impacts to the SAV beds during construction. It is our intent to survey the seagrass resource prior to construction and monitor how it changes over time. We also will compile existing information about potential impacts from shading from structures. We hope we can use this information to work with your staff and the CRC to develop standards to address our concerns. Give me a call if you need more information. P3. MOFFITT Date: November 6, 1998 DIRECTOR Over the last several months, we have been discussing the potential impacts of pier construction on submerged aquatic vegetation (SAV) with the Corps of Engineers (COE). The National Marine Fisheries Service (NMFS) has expressed concerns to the COE that potential adverse impacts to SAV could be caused by the shading effects of pier decking and the associated boating activity which takes place adjacent to the pier. The NMFS has provided copies of several studies which were done in other parts of the country to help document the problem. I have previously sent a copy of these reports to each of the field offices. The COE has asked if we could help them quantify the number general permits we issue for pier construction that have some portion of the structure over SAV. I have agreed and would request you to denote on the face of the issued General Permit the acronym "SAV" if any submerged vegetation is visible or present during your site visit.
