Ross Jr., Secretary April 21, 2003 Mr. Mark Mankoff, and Ms. Ruth Mankoff 4 Valley View Court Pomona, NY 10970 Re: Eugene and Linda Struminiski Permit Lot 35, Block B, Indiantown Shores, Dare County Dear Mr. Mark Mankoff, and Ms. Ruth Mankoff Thank you for your letter of January 24, 2003. This letter is in reference to that correspondence, as an adjacent riparian property owner, objecting to a permit request from Eugene and Linda Struminiski of Dare County, to stabilize the shoreline of their property located along the Pamlico Sound at Indiantown Shores. To reduce erosion along their property shoreline, the Struminiski's plan to construct a bulkhead/retaining wall along this shoreline. This type of development will require the issuance of a Coastal Area Management Act Permit. To satisfy permit pre -requisite requirements, permit applicants must notify their adjacent riparian neighbors in regard to their proposed development. Dennis W. Hawthorn of the Division of Coastal Management staff was recently onsite, and has reviewed the Struminiski 's proposal to build a shoreline stabilization structure. During the permit review process, Mr. Hawthorn discussed this project with the applicant's and noted that the original bulkhead alignment would result in the filling of Coastal Wetlands, and would require a more detailed review under the CAMA Major Permit review process. In addition, Mr. Hawthorn indicated that this bulkhead alignment might not be permitted, as it would result in the filling of a wetland fringe. Subsequently, Mr. Hawthorn recommended that the applicants relocate the bulkhead alignment landward of all wetlands. This alignment would result in the filling of no wetlands, or waters, while providing protection to the upland portion of the Struminiski property. The Struminiski's considered and accepted this revised alignment. Mr. Hawthorn reviewed all aspects of this proposal for consistency with 15A NCAC 07H .1100, and has thoroughly reviewed your letter stating your concerns. This review has found the proposed development to be consistent with rules and guidelines specified in 15A NCAC, Section 07H .1100. In this regard, on April 11, 2003, the Division issued General Permit # 33090 (copy attached) on April 11, 2003 for the proposed development. If you wish to appeal this permit decision, you must request the appropriate application forms, and file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within 20 days of the permit decision.
