Ross Jr., Secretary January 10, 2003 Permit Decision for Press and Rosemary Steele, Dare County Dear Ms. Williams: This letter is in reference to your October 25, 2002 correspondence, as an adjacent riparian property owner, objecting to a request from Press Steele of 4008 Martin's Point Road, Dare County, located along the Currituck Sound. This objection concerns the construction of a pier and platform along this shoreline. The proposed pier will extend 100-feet beyond the waterward edge of the marsh area along the Steele property shoreline. The structure will include a 120- square foot platform at the waterward end of the pier, and the pier walkway alignment will be 38- feet south of your property line. Dennis W. Hawthorn of the Division of Coastal Management staff on November 21, 2002 was onsite, and has reviewed the Steele's proposal to build this pier structure. Mr. Hawthorn informed me that he has spoken with you in regard to this proposal in order to understand and address your concerns regarding their pier structure alignment. He has also informed me that he has spoken to the Steele's and their contractor, Sandmark Construction, on several occasions in hopes of modifying their project in some way to resolve this matter. Mr. Hawthorn reviewed all aspects of this proposal for consistency with North Carolina Administrative Code (NCAC), Subchapter 7H, Sections .0208 and .1200. This review has found the proposed development to be consistent with above referenced NCAC Subchapter Sections. Mr. Hawthorn has thoroughly reviewed your circumstances, and letter stating why you object to the Steele's pier alignment. Mr. Hawthorn has informed me that he has also informed you that the proposal is consistent with the pertinent rules of this Division, the probable permit issuance, and the low probability of any denial of this permit. He has also discussed with me that the Steele's proposal is also consistent with the recent Martin's Point Home Owners Association's rule change restricting pier alignments to the center 50 % of the lot's shoreline. He informed me that, in this regard, you would send additional correspondence, reversing your objection, but would appreciate if he would ask one more time if the Steele's would re -consider moving their pier closer to the center of their lot. Today, the Steele's contractor, Mr. Martin, asked that the requested permit be issued for this pier structure. At this time, Mr. Hawthorn, again mentioned your concern and request to move the pier alignment further away from your home and property line.
