Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Ms. Murrell:
This correspondence is in reference to your August 14, 2003 letter of objection to Mr.
Mark Schrecker's proposal for a pier. The proposed project is located at 204 North Holland
Point Drive, in the White Oak Landing near Swansboro, on the White Oak River, Onslow
County, North Carolina.
In your letter you voiced an objection over the location of the proposed pier,
specifically the fact that the pier was being aligned in front of your house and property. The
Division of Coastal Management reviewed your concerns, worked with Mr. Schrecker and his
contractor to establish the riparian lines and an appropriate location for the pier. As such, the
Division determined that the project would be in compliance with the pertinent rules of the
Coastal Resources Commission with some adjustments. Consequently, the Division issued
CAMA General Permit #34775-C to Mr. Schrecker for a 200' pier with a 10' X 10' platform.
Enclosed you will find a copy of the issued permit with specific conditions. If you wish
to appeal this permit decision, you must file a Third Party Hearing Request with the Director
of the Division of Coastal Management, Ms. Donna Moffitt, Department of Environment and
Natural Resources within 20 days of the permit decision. The Director's mailing address is
1638 Mail Service Center, Raleigh, NC 27699-1638. The pertinent form is enclosed. A copy
should also be sent to the Attorney General's Office, Environmental Division, at the address
shown on the Certificate of Service form. If you have any questions regarding this matter,
please don't hesitate to contact me at my Morehead City Office (252-808-2808).

Dear Ms. Barrett,
I appreciate you speaking with me today concerning my new neighbor's request for me to
sign a pier plan that I did not agree with. As I stated, his plans show his pier would go in
front of my house and would meet the area where I had planned to build a pier.
Enclosed is a map of the area I am referring to and a copy of the letter I had from Bradley
Nofzinger, CAMA Officer in 1990, which I understand from you, is no longer valid due
to the date. My new neighbors are on Lot #8 and as you can tell 75% of their lot is in
front of the neighborhood pier that was built approximately 15 years ago.
In 1986 I had the opportunity to purchase Lot # 7 or Lot #8. I spent $9,000 additional
dollars for Lot # 7 due to the fact that the neighborhood pier did cover the front of the
Lot # 8. I do not think that it is right now that they be able to build in front of me.
However, I have no problem with anything he wants to do in front of his home.
I also discussed with the new neighbors that this does not even take into account the
space for�thei3 water vehicles, anchor lines, and other posts that they would want.

We have received the information submitted to this office in your
inquiry concerning the necessity of filing an application for a
minor development permit under the Coastal Area Management Act.
The activity you propose is exempt from needing a minor
development permit as long as it meets the conditions specified
below. If your plan should change and your project will no
longer meet those conditions, please contact me before
proceeding.
DESCRIPTION OF ACTIVITY AND CONDITIONS: To construct a pier
(6' x 1201), at Lot # 7, White Oak Landing Subdivision, Swansboro
Township, Onslow County, North Carolina and shall be exempt from $
a CAMA permit if the following conditions are met:
A private noncommercial pier may be constructed if it does not
exceed 200 feet in total length off -shore; is not within 150 feet
of a federally maintained channel; does not exceed 6 feet in
width; does not include an enclosed structure, and does not
interfere with established navigation rights. If may be built
through wetland vegetation only if elevated and may have a T-
head or- platform not exceeding 500 square feet in area at its
waterward established pier length along the same shoreline for
similar -use and in no case extend more than one-third of the
width of the water body and shall not interfere with shellfish
franchises or leases.
