This correspondence is in reference to your March 17, 2003 letter of objection to the
Sandy Point Homeowners Association (HOA) proposal for a rock access ramp. The project
would be located on lot #70 in Sandy Point Subdivision, in Merrimon, on the Neuse River,
Carteret County, North Carolina.
In your letter you voiced several concerns over the water -access ramp actually being a
boat ramp, the stability of the rock used in the construction of the ramp, the shallowness of the
water in the area, and the potential impacts of the ramp on the shoreline affecting
accretion/erosion of sand in the area. Rest assured that the Division of Coastal Management
(DCM) has reviewed your concerns and have worked with the applicants to ensure that the
proposed project is in compliance with the pertinent rules of the Coastal Resources
Commission. After much discussion, a lot of project modifications, and many specific
conditions being attached, the DCM issued CAMA General Permit #34548-C to the HOA
authorizing the proposed access ramp.
Enclosed you will find a copy of the permit with specific conditions. If you wish to
appeal this permit decision, you may file a request with the Director of the Division of Coastal
Management, Ms. Donna Moffitt, Department of Environment and Natural Resources within
20 days of the permit decision. If you have any questions regarding this matter, please don't

Re: Adjacent Riparian Property Owner Notification/Waiver Form, Lot #71
I have reviewed the proposed Water -Access Ramp described in the application
submitted by the Sandy Point Homeowners Association for Lot 70, or Commons Area.
I am opposed to the construction of such a ramp. After extensive consultations with
Marine Engineers, CAMA Experts, and my own experience with the effects of storms on
this shoreline, I am against this project. My reasons are as follows:
• 100% of the experts I consulted confirmed the fact that such a ramp, or access, will
not survive the first major storm, let alone a hurricane.
• The "Water -Access" ramp is really a boat ramp. Given the ramp width, length, and
construction description, a storm of any significance will destroy the integrity of the
ramp. This will potentially leave large boulders as well as the gravel topping used in
the ramp scattered all along the site of the boat ramp. These boulders will create a
hazard for both swimmers and boaters, as well as an eyesore.
• Due to the extreme shallowness of the water in this area, only very small boats, keel -
less sailboats, and jet skis would be potential users. Neither of the two boat types
could cause material damage, but the constant action of the wakes created by jet
skis will serve to further aggravate the erosion of the shoreline.
• The degradation of such a ramp will irreparably alter the natural ebb and flow of sand
at this point. Lot #69 is particularly at risk for destruction of the sand barrier between
the sound and the spring -fed pond and adjacent wetlands. In the last major storm
prior to shoreline stabilization, Lot # 71 lost over fifty feet of lot depth, not to mention
dozens of trees, shrubs and other vegetation which serve to stabilize the soil.
• Since the shoreline stabilization project 2 years ago, running from lot #69 to #74?,
the entire shoreline has not suffered any major deterioration.
• Finally, should the applicant, the Sandy Point Homeowners Association, be granted
a permit to construct such a boat ramp, I will expect written agreement from the
Association to repair any and all property damage to lot #'s 69, 70, and 71, occurring
after the beginning of construction on this boat ramp.

Although I have not yet received my copy of the Adjacent Riparian Property
Statement, I did see the copy of a proposed drawing for a beach access. I will
not support construction of the proposed beach access for a number of reasons.
Please allow me to list just a few.
Prior to purchasing lot 71 at Sandy Point, both Jerry Evans and Ed
Mitchell of Weyerhaeuser Real Estate Company described to me the
"beach access" envisioned at the time of the development. We purchased
lot 71 knowing full well that Weyerhaeuser had set aside funds for and had
oral discussions about an access which was described to me as follows:
o "A gradual leveling of the grade to allow access for very shallow
draft vessels, (Hobie Cats, Sunfish, etc)". Weyerhaeuser proposed
the placement of a small section of metal mesh similar to the type
used by the military to stabilize an otherwise shifting and unstable
surface upon which to move vehicles and facilitate access to the
water for wheeled vehicles to load/unload boats, etc.
2. There is no disagreement that the access as described above was fully
addressed, discussed and agreed to prior to the purchase of lot 71. In
point of fact, there was specific written language in my purchase contract
regarding both proximity to and direction of such a beach access adjacent
to lot 71. As described, this access was to be used only casually, and
only by property owners from Sandy Point and the Weyerhaeuser South
River development.
3. Approximately 2-1/2 years ago, a very elaborate shoreline stabilization
project was undertaken. Starting at the Shuping property (lot 69), and
running sequentially up towards 78-80? (1 am not sure where the shoreline
stabilization ends) the entire shoreline was stabilized. Beginning with lot
70, the shoreline was trenched to a depth of approximately three feet
below the existing grade level. The entire shoreline trench was then lined
with a special mesh fabric designed to prevent silt escapement, and loss
of sand through wave action. Large granite boulders were trucked in from
Rocky Mount, and were placed by a "cherry -picker" device to maximize
interlocking and minimize the likelihood of shifting. Over time, the sand
has come and gone somewhat since the shoreline stabilization. The
heaviest loss has been principally on lot 69 and the adjacent portion of 70.
However, from 71 upwards, there had been a very nice buildup of sand.

Some lots are enjoying the formation of mini -sand dunes created by wind-
blown sand blowing up and over the stabilized shore. Numerous property
owners have planted a native sea grass which has thrived nicely and has
propagated very effectively over the past two years.
4. As sketched in your proposal, your plan appears to call for the following:.,
a. A "cutting through", "rounding over", removal, alteration or
otherwise reducing the existing height of the present stabilized
shoreline to gain access to the water
b. Creation of some sort of a downward -sloping approach which
would begin its down -slope ahead of the new "high point" (or low
point, depending on definition) on the now -breeched previously -
stabilized seawall.
c. Removal, cutting through, destruction or degradation of the silt -
mesh installed to prevent sand erosion behind/between and under
the granite boulders to gain access to the beach.
d. The removal of existing sea grasses and other native vegetation it
the area which further serves to stabilize that area.
e. Potential removal of indigenous living trees which would further
negatively affect the soils held together by the root structure of
these trees.
5. Here are just a few of my concerns regarding the construction of
such a beach access (please refer to item #1 of this memo): I knew and
accepted the "terms of the deal" for the purchase of lot 71, based on the
oral commitments made to me and my wife by Ed Mitchell and Jerry
Evans to prior purchase of lot 71.
6. In a hand -drawn sketch, you propose to breach the seawall adjacent to my
now -stabilized and growing property, and install an access point for north-
eastern driven windstorms to eat away at the most vulnerable section of
both lot 71 as well as the property adjacent to me, lot 70.
7. 1 invested over $12,000 in the stabilization of the shoreline of lot #71 after
the loss of over almost 100' of depth of my lot's sea frontage not to
mention over 70 trees, following Hurricane Dennis.
8. In a recent article in Environment magazine, they point out a very relevant
fact, "...economic analysis also revealed a strong relationship between
good beach quality and the price of inland and waterfront properties. In
the southeast United States, waterfront and inland property values are
higher in communities with good beach conditions... If beach conditions
deteriorate... property values decrease by as much as 20%. Protective
armoring (shoreline stabilization) increases the value of waterfront
property by about 25W

9. In a publication from UNESCO, they state, "Removing vegetation from the
dunes destabilizes these protective sand barriers, resulting in increased
soil and dirt particles being washed offshore. ...this is a key habitat for
many species of crabs, fish, and seabirds, as well as for the smaller
creatures that serve as food for these larger animals". The same article
states that..."Since 1995, the Atlantic Basin, (including the Atlantic Ocean,
the Caribbean Sea, and the Gulf of Mexico) has entered a more active
hurricane cycle, which may continue for more than 20 years."
10. The Heinz Center recently published an extensive article stating that "the
effects of armoring (shoreline stabilization), generally last longer than
other methods".
11. To summarize, I am strongly against the construction of any access that
would breach the existing shoreline stabilization. I was at Sandy Point
yesterday. In just the last northeaster, Weyerhaeuser lost almost all their
sand and seagrass. I lost almost half of my sand, but more importantly,
because of the wave and water action, ALL the shoreline boulders have
actually sunk about two feet vertically into the sandbed, lowering the level
of my shoreline, and making my property even more susceptible to
overwash in the event of storms. Repeating earlier items above, I knew
the construction of a simple beach access was a possibility. But, that
access was to be built from the prior shoreline, and was never intended
(according to my recollection and Weyerhaeuser's) to be built in such a
method that would pose such serious threats.
12. In my opinion, if a pair of large seawalls parallel with and on each side of
the proposed ramp, extending perpendicularly to the shoreline running out
100 to 150 feet from the shoreline, and 3-4 feet above mean high water,
this might provide a measure of reassurance that further washing away
my property could be avoided. I seriously doubt that Weyerhaeuser would
pay for it, and I doubt CAMA would permit it. In discussing the proposed
access with Weyerhaeuser officials several weeks ago, they suggested
that in lieu of construction the access, the HOA take the money set aside
for this access and use it to improve the entryway to Sandy Point-- an
entry worthy of the beautiful area we will be calling our homes. The
present entryway certainly does not reflect the quality of the area, and
should be significantly improved. Using Weyerhaeuser's set -aside money,
we can have an entryway we can all be proud of.
I sincerely hope that you and the association can see this issue from my point of
view. I hope you can appreciate the fact that I potentially could suffer irreparable
loss of frontage due to an alteration to the existing stabilized shoreline. I also
hope CAMA has the wisdom to disallow such a potentially damaging breach to
occur.

After reviewing the proposed drawings and discussing the project with Mr. Brad Shavers
of CAMA, we wish to express the following concerns:
a) Mr. Shavers was very concerned with the stability of the water access ramp. He
stated that a ramp extending into the Neuse River would be damaged or destroyed
by the first major storm, thereby scattering rocks over the neighboring beaches.
Additionally, these scattered rocks would create underwater hazards to bathers
and boats.
b) There was also a discussion on the feasibility of the sand building up on one side
of the ramp and eroding on the other side. On Lot #69, CAMA will not allow for
rocks to be laid over the existing bank in order to stabilize the bank. This is due

Construction of this ramp could further jeopardize an already precarious
condition.
c) If the homeowners wish to proceed with this project we would request an
assurance in writing that the homeowners association restore the adjoining beaches on
lot #69 and #71 or any other beach front property that may be affected to their
original state prior to construction. We would also request in writing what measures
would be taken to repair the ramp after storms.

The Small Watercraft Access ramp located on common area Lot #70, within the Sandy Point Sub -division, will be
constructed of the same size and material that the present stabilized wall is constructed of. The present wall is made of
Granite each piece is app. 50 to 100 lbs. The top of the ramp will be made as smooth as possible using the flat side of these
pieces. The ramp will butt the stabilized wall, and run parallel to the existing point located on this site and extending past it
by about 1 Oft.

Apparently after speaking with Pete this morning the stakes I placed under the advisement of Mr.
August were incorrect. The ramp is proposed in approximately the same location but is proposed to
extend 10' beyond the "point" which still puts it well inside of 20' seaward of the normal water level, the
regulation restriction. I hope your conversation with Pete clarified the proposal. Let me know if I can be
any more help.

This correspondence is in reference to your March 17, 2003 letter of objection to the
Sandy Point Homeowners Association (HOA) proposal for a rock access ramp. The project
would be located on lot #70 in Sandy Point Subdivision, in Merrimon, on the Neuse River,
Carteret County, North Carolina.
In your letter you voiced several concerns over the water -access ramp actually being a
boat ramp, the stability of the rock used in the construction of the ramp, the shallowness of the
water in the area, and the potential impacts of the ramp on the shoreline affecting
accretion/erosion of sand in the area. Rest assured that the Division of Coastal Management
(DCM) has reviewed your concerns and have worked with the applicants to ensure that the
proposed project is in compliance with the pertinent rules of the Coastal Resources
Commission. After much discussion, a lot of project modifications, and many specific
conditions being attached, the DCM issued CAMA General Permit #34548-C to the HOA
authorizing the proposed access ramp.
Enclosed you will find a copy of the permit with specific conditions. If you wish to
appeal this permit decision, you may file a request with the Director of the Division of Coastal
Management, Ms. Donna Moffitt, Department of Environment and Natural Resources within
20 days of the permit decision. If you have any questions regarding this matter, please don't
hesitate to contact me at my Morehead City Office (252-808-2808).

This letter serves as confirmation that the water access point on Lot #70 Sandy Point
Subdivision has been installed within the limits of the issued general permit. General Permit#
34548 was issued for a water access ramp on 7/15/03. The project was completed shortly after
permit issuance and this office has confirmed the finished access point is compliant with General
Permit # 34548.
The project site was visited shortly after Hurricane Isabel to assess the damage from the
storm. A portion of the smaller rock used to fill gaps in the ramp had been displaced, a result of
the storm surge. The Sandy Point HOA is aware that the rock can be replaced within the
footprint of the original permit without requiring an additional permit from this Division.
