Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Ross 6200 Pelican Dr. New Bern, NC 28560 Dear Mr. Ross: This letter is in reference to your June 12, 2003 meeting with Ms. Tracey Wheeler of my staff, on your property at 6200 Pelican Drive, on a canal off Spring Creek, in Fairfield Harbor, Craven County, North Carolina. The purpose of the visit was to evaluate the site for potential modifications to your existing pier (i.e. the addition of two mooring pilings). Ms. Wheeler issued CAMA General Permit #34061-C to you for the installation of the pilings to be located 13' waterward of the existing 5'-wide parallel dock. This permit extended the structure (pier and mooring pilings) to one -quarter the width of the canal. I now understand that you wish to extend the mooring pilings out to one-third the width of the canal. The canal adjacent to your property is 72' wide and the project as permitted on allows the two mooring pilings to extend to a distance of 18' off the bulkhead. The placement of any structure farther offshore would exceed 1/4 the width of the canal and would therefore be inconsistent with 15A NCAC 07H.0208(b)(6)(J)(iii) and 15A NCAC 07H.1205(n) (see attachments). The 1/4 limitation shall not apply when the proposed pier is located between longer piers within 200 feet of the applicant's property. This is not the situation in your case. Therefore, your request to place pilings farther than General Permit #34061-C authorizes is hereby denied. You may request a variance from the riles from the Coastal Resources Commission (CRC). The earliest that the request could be heard would be the CRC meeting in October. I am enclosing a variance request form for your use. Ross Jr., Secretary This correspondence is in reference to your recent letter of objection to the installation of mooring pilings adjacent to your neighbor's dock, Mr. George A. Ross. Mr. Ross proposes to install two mooring pilings 13' waterward of his existing side -to dock. The pilings would be located a total distance of 18' out into the canal. The project would take place at 6200 Pelican Drive, on a canal off Spring Creek, in Fairfield Harbor, Craven County, North Carolina. It appears that your objection is based upon the project limiting you and your neighbors at the end of the canal from navigating in and out of future docks at the site. The Division of Coastal Management (DCM) has reviewed the proposal and it appears that the project as proposed meets the so-called " 1/a rule" and is within his riparian area meeting the required 15' setback. Therefore, on June 12, 2003 the DCM issued General Permit #34061-C to Mr. Ross for installation of the two mooring pilings. Enclosed you will find a copy of the permit with specific conditions. If you wish to appeal this permit decision, you may file a request with the Director of the Division of Coastal Management, Ms. Donna Moffitt, Department of Environment and Natural Resources within 20 days of the permit decision.
