violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available

RE: Proposed Bridge Replacement on Oakleaf Drive over McNeils 01-077
Inlet (B-4335), Pine Knoll Shores, Carteret County
Dear Bill:
The purpose of this letter and attachments is to notify the N.C. Division of Coastal Management
(DCM) of proposed impacts to estuarine waters associated with replacement of Bridge No. 46 on
Oakleaf Drive over McNeils Inlet in Pine Knoll Shores. The proposed project calls for replacement
at the existing location with an off -site detour. The activity will result in the removal of existing
wood and concrete piles and the insertion of new concrete piles in estuarine public trust waters.
Total jurisdictional area impacts are limited to the insertion of eight 20-inch diameter concrete piles
into an estuarine water bed. Proposed impacts are requested to be authorized under a Coastal Area
Management Act (CAMA) general permit. No vegetated wetlands will be impacted by the project.
No compensatory mitigation is proposed for project impacts.
Bridge No. 46 is a two-lane structure with an overall span of 120 feet and a deck width of 25 feet.
The bridge spans a man-made canal know as McNeils Inlet, which is approximately 96 feet wide and
is bounded on each side by a plastic and wooden bulkhead. Land in the four quadrants of the
crossing is high ground (approximately 10 to 15 feet above sea level), developed and maintained as
residential lots and a community park. The primary vegetation cover in the bridge vicinity is
maintained grasses and herbs. The McNeils Inlet canal is characterized by an unconsolidated bottom
with no submersed aquatic vegetation varying in depth from sea level along the outer fringes of the
channel to 4 feet deep (at mean low tide) at mid -channel. The distance from water surface to the
bottom of bridge is a minimum of 8 feet (at mean high tide).
This permit application includes 1) information attached to this letter and 2) information to be
delivered by the Town of Pine Knoll Sh.,:es. 1 he Town of Pine Knoll Shores (in the person of Mr.
Chris Jones) is going to provide you with evidence of project notification to the adjacent landowners
(green return cards from certified mail) and a check covering the permit fee ($250.00).

following items must be submitted:
• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrumentVunder
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an S 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Dear Ms. Vinson:
This letter is sent to your office as directed in a certified letter that we received today, March
15,2001 from the Town of Pine Knoll Shores (PKS). The letter states that PKS is in the process
of getting "final permits" required for the McNeil Inlet Bridge on Oakleaf Dr.
Some months ago, residents to be impacted by the bridge project met with PKS and contract
engineering persons to learn more about the specifics of the bridge project. During that meeting
many of the residents on either side of the bridge voiced concerns about what the new bridge
increased deck size and access profiles would do to water drainage and driveway access and
egress safety. These concerns included drainage of rainwater off of the bridge deck versus the
current "through the deck", water accumulations in yards due to the access profiles blocking
current water flows, and fears of residential flooding due to these changes.
At the conclusion of that meeting, PKS promised the impacted residents that they would be kept
advised of the bridge project protocols. I personally have heard nothing since that meeting.
PKS promised to have at least another meeting for the impacted residents before anything "final"
was decided upon. The wording in the certified letter I just received from PKS clearly states that
PKS "is now in the process of finalizing the permits that are required for the bridge replacement
project." I feel the NC Division of Coastal Management needs to be made officially aware of the
"missing" meetings promised by PKS before anything "final" is done. I do not know what the final
Permits entail, but I do not want any horses getting ahead of any carts i trust yotir office will not
issue any "final' permits until the above resident concerns have been dealt with.
I look forward to your offices written response. I will be out of town Monday and Tuesday,
March 18 & 19 but as you can see I have provided my home office phone (with answering
machine) and fax numbers in the letterhead above.

On April 18, 2002, the Wilmington Regional Office received a copy of a CAMA Application for B-4335
McNeils Inlet Bridge Replacement. The North Carolina Administrative Code requires any project that must receive
either Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit to apply for and receive a
Stormwater Management Permit by the Division of Water Quality. Any construction on the subject site, prior to
receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate
enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application form,
fee, and supporting documentation, or a written response regarding the status of this project and the expected
submittal date must be received in this Office no later than May 24, 2002. Failure to respond to this request may
result in the initiation of enforcement action, and construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval letter
must NOT be considered the Coastal Stormwater Management Permit, which will be signed by the Water Quality

The stormwater rules require DOT to do the best they can do regarding
road and bridge projects. Our stance on deck drains is to encourage the
elimination of direct discharges to waters of the State.
