Ross Jr., Secretary October 21, 2002 Mr. Joseph Topolski 133 Pearson Circle Newport, NC 28570 Dear Mr. Toposki: This correspondence is in reference to your October 14, 2002 objection letter to the recent marina reconfiguration proposed by Osprey Oaks Marina. The project is located at 3197 NC Highway 24, on Broad Creek, near Newport, Carteret County, North Carolina. Currently, the Osprey Oaks Marina proposes to install a 13' X 13' uncovered boatlift in existing slip #6 and to add one new and rebuild two 2' X 26' finger piers within the existing slip #s 4, 6, and 8. All development is proposed within the existing footprint of the marina. It appears that your objection is based on wanting no more boatlifts or floating docks at the marina. It also appears that you have voiced an objection dated October 15, 2002 on behalf of a Broad Creek Homeowners Group wanting no expansion of the marina. The North Carolina Division of Coastal Management has given careful consideration to your objections and has determined that the project is consistent with 15A NCAC 07H .2000 - General Permit for Authorizing Minor Modifications and Repair to Existing Pier/Mooring Facilities in Estuarine and Public Trust Waters. Therefore, on October 21, 2002, the Division issued CAMA General Permit #32390-C for installation of the boatlift and finger piers. I have enclosed a copy of the permit for your review. Although the permittee has discussed additional development including possible marina expansion, no application has been accepted as complete and none is being processed. As an adjacent riparian property owner, you will be provided a copy of any such proposal. If you wish to appeal this general permit decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within 20 days of the permit decision.
