So if I am understanding correctly the information in your letter dated April 19, 2010, as well as the riparian lines layout document, the riparian lines are drawn so that Mr. Ritchie's riparian corridor is within all of the borders that he wanted and that you set last week. Although this was not what was agreed upon nor what I signed off on or was received by me for my review during the last 9 months. We signed the adjacent property riparian notification form on July 11, 2009, and contested it verbally with Ms. Barrett and Ms. Styron. All of these concerns were discussed in our July 28, 2009 meeting with Ms. Styron and Ms. Barrett and was confirmed by Ms. Barrett that the pier would be 50 ft from my landing and at the end of his platform would be 35 ft from my landing. The future documents that I received and signed were not the structure that was built, and so now it has been changed so all agreements are off and that everything that the persons wanted was approved. How convenient, no builders nor new neighbors have to make any changes because of the new riparian lines. Ms. Styron in her March 24th letter stated that she told the contractor that the 2 outer pylons would have to be removed thus reducing the size of the platform to 10 x 8 because that is what was within our perimeters and promised as well as many other things that we have documented. Please confirm that I am understanding correctly that the pylons will not be removed and that the platform is now larger than planned. Thanks for your assistance! The proposed project is located on Bogue Sound at 204 Forest Knoll Drive, in Atlantic Beach, Carteret County, North Carolina. On April 14, 2010, the Division established and staked definitive common riparian lines for the properties in question. The Division also reviewed all your concerns and objections to the proposed project. After reviewing the proposal along with your objection, the Division has determined that the proposed development is in compliance with the rules of the Coastal Resources Commission in 15A NCAC 07H.1200. Therefore, the Division issued CAMA General Permit #55391-C to Mr. Ritchie on April 19, 2010 for the installation of two boatlifts (one measuring 12'W X 13'L and one measuring 13'W X 15'L) and for the expansion of the existing dock to a total of size of 10'X18'. From: Ed Weaver [eeweaver@yahoo.com] Sent: Wednesday, March 10, 2010 10:46 PM To: Styron, Heather M.; Barrett, Tere Cc: eeweaver@yahoo.com Subject: 202 Forest Knoll Pier discrepancies Ms. Styron, as you requested, we have drawn and are faxing to you the agreed upon specifications and the reasons for us declining the proposed changes received this week from Eric Ellis for the pier next to our property located at 202 Forest Knoll Drive. Please see the faxed drawing of the specifications agreed upon during our meeting with you and Ms. Barrett. The following listed items are contrary to the original configuration drawing and agreement, and does not have our approval for the proposed changes that were received from Mr. Ellis: • The certified specification letter dated March 3, 2010 that was received by Elizabeth Weaver on March 8, 2010 does not reflect accurately the direction of the pier that was agreed upon last summer. Please see the faxed attachment. ® My wife and I met and discussed the original specifications with Tere Barrett and Heather Styron of the NCDENR, Division of Coastal Management in the late summer of 2009 and based on that meeting a writtteri modification was filed by them, and approved for the pier at 204 Forest Knoll Drive. These minor changes were based on fairness to all parties involved, the laws and guidelines were provided by Ms. Styron and Ms. Barrett and the fact that all involved were willing to give a little up to come to a compromise with our neighbors. Since we did not agree to wave any setbacks, the agreement was that the pier would be 35 feet parallel from the end of our platform projection to the furthest corner of his platform. • When standing on the corner of our property line, the pier is being built toward the east and straight into our aligned water space headed east AND NOT straight out as the drawing from Mr. Ellis states. • Another proposed change is asking that the deck at the end of the pier should be changed from a T to an L and if approved it will be closer to our pier than originally stated and agreed upon, and will be crossing in front of any extensions for our pier. When we or the residents of our property at a future date decide to extend our pier if the new plan is approved, we will not be able to do so without running into our next door neighbor's space. Please see the faxed drawing of the specifications agreed upon during our meeting with you and Ms. Barrett. The following listed items are contrary to the original configuration drawing and agreement, and does not have our approval for the proposed changes that were received from Mr. Ellis: • The certified specification letter dated March 3, 2010 that was received by Elizabeth Weaver on March 8, 2010 does not reflect accurately the direction of the pier that was agreed upon last summer. Please see the faxed attachment. • My wife and I met and discussed the original specifications with Tere Barrett and Heather Styron of the NCDENR, Division of Coastal Management in the late summer of 2009 and based on that meeting a writtten modification was filed by them, and approved for the pier at 204 Forest Knoll Drive. These minor changes were based on fairness to all parties involved, the laws and guidelines were provided by Ms. Styron and Ms. Barrett and the fact that all involved were willing to give a little up to come to a compromise with our neighbors. Since we did not agree to wave any setbacks, the agreement was that the pier would be 35 feet parallel from the end of our platform projection to the furthest corner of his platform. • When standing on the corner of our property line, the pier is being built toward the east and straight into our aligned water space headed east AND NOT straight out as the drawing from Mr. Ellis states. • Another proposed change is asking that the deck at the end of the pier should be changed from a T to an L and if approved it will be closer to our pier than originally stated and agreed upon, and will be crossing in front of any extensions for our pier. When we or the residents of our property at a future date decide to extend our pier if the new plan is approved, we will not be able to do so without running into our next door neighbor's space.
