This letter serves as a follow-up to our April 30, 2010, onsite meeting at Davis Landing Park at
the head of Davis Landing Canal, Pine Knoll Shores Extension, Sections 4 & 5 off Loblolly Drive, in
Pine Knoll Shores. Also in attendance was your Surveyor, Mr. Thomas Strickland, and Brad Connell,
field representative for the Division of Coastal Management (Division). The purpose of our meeting
was to discuss the riparian lines at the head of the canal where the Town boat ramp and dock are
located. This letter also provides an explanation as to how the DCM determined those riparian lines.
If you recall during our site visit, the Division determined the riparian lines in accordance with
the 15A NCAC 07H.1205(q) that states in part that "The line of division of areas of riparian access
shall be established by drawing a line along the channel or deep water in front of the property, then
drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point
the upland property line meet's the water's edge." The Rule goes on to say that "When shoreline
configuration is such that a perpendicular alignment cannot be achieved, the pier or docking facility
shall be aligned to meet the intent of this Rule to the maximum extent practicable." Since the
properties in question are located at the head of the canal, staff applied the maximum extent
practicable criteria in determining the specific locations of the riparian lines. Applying the maximum
extent criteria of the Rule in this case is consistent with the North Carolina Court of Appeals Case NO.
COA96-347 in Pine Knoll Association, Inc. v. Marvin G. Cardon, since the location is the same. In
that case, the Court found that "where the configuration of the shoreline is essentially a right angle, as
this case was, that it believed the "reasonable use" test was the most equitable method to determine an
owner's rights. It also found that in applying the "reasonable use" test, the owner's use of the waters
adjacent to their property is governed by a "reasonableness, and must be restricted so as not to
interfere with the correlative rights of other littoral owners." This is exactly what the Division did on
April 30, 2010 in setting the riparian lines at the site.
The riparian survey performed by Strickland Surveying, P.A. and dated 5/3/10 reflects the
riparian lines established by the Division of Coastal Management and will be used by the Division in
the future for any water -related permitting activities that are proposed at the head of this canal.

This letter serves as a follow-up to our April 30, 2010, onsite meeting at Davis Landing Park at
the head of Davis Landing Canal, Pine Knoll Shores Extension, Sections 4 & 5 off Loblolly Drive, in
Pine Knoll Shores. Also in attendance was your Surveyor, Mr. Thomas Strickland, and Brad Connell,
field representative for the Division of Coastal Management (Division). The purpose of our meeting
was to discuss the riparian lines at the head of the canal where the Town boat ramp and dock are
located. This letter also provides an explanation as to how the DCM determined those riparian lines.
If you recall during our site visit, the Division determined the riparian lines in accordance with
the 15A NCAC 07H.1205(q) that states in part that "The line of division of areas of riparian access
shall be established by drawing a line along the channel or deep water in front of the property, then
drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point
the upland property line meet's the water's edge." The Rule goes on to say that "When shoreline
configuration is such that a perpendicular alignment cannot be achieved, the pier or docking facility
shall be aligned to meet the intent of this Rule to the maximum extent practicable." Since the
properties in question are located at the head of the canal, staff applied the maximum extent
practicable criteria in determining the specific locations of the riparian lines. Applying the maximum
extent criteria of the Rule in this case is consistent with the North Carolina Court of Appeals Case NO
COA96-347 in Pine Knoll Association, Inc. v. Marvin G. Cardon, since the location is the same. In
that case, the Court found that "where the configuration of the shoreline is essentially a right angle, as
this case was, that it believed the "reasonable use" test was the most equitable method to determine an
owner's rights. It also found that in applying the "reasonable use" test, the owner's use of the waters
adjacent to their property is governed by a "reasonableness, and must be restricted so as not to
interfere with the correlative rights of other littoral owners." This is exactly what the Division did on
April 30, 2010 in setting the riparian lines at the site.
The riparian survey performed by Strickland Surveying, P.A. and dated 5/3/10 reflects the
riparian lines established by the Division of Coastal Management and will be used by the Division in
the future for any water -related permitting activities that are proposed at the head of this canal.
