(i) Common Expenses shall mean all expenses of administration, maintenance, repair or replacement of Common Areas, the expenses agreed upon as Common Expenses by the Association, and such other expenses as may be declared to be Common Expenses in this Declaration. (j) Common Profits shall mean the excess of all receipts of the Association including, but not limited to, assessments, rents, profits and revenues on account of the Common Areas, over and above the Common Expenses. The location of the Oriental Condos as shown on the copy of the Town of Oriental map is on the N. C. Wildlife Commission property's boat access. I cannot make out just where the dredging is to be done, but I strongly request that the spoil be carefully contained during the operation so that it will not drift over beneath the slips and turning area at my pier. You note that you received a copy of the proposal on November 101h. The applicant has submitted delivery confirmation for October 10, 2009. The General Permit (#54692C) for maintenance excavation was then issued ten (10) days later and is set to expire on May 1, 2011. I believe that the applicant had erroneously sent you a full CAMA Major Permit application, when in fact the DCM district staff had made the determination that this project met the General Permit standards instead. This General Permit only addresses the excavation aspect of the proposed development. I do understand, from conversing with Mr. Baskerville, that the Oriental West COA does wish to reconfigure the marina sometime in the near future as well. The DCM will evaluate that proposal when it is received. If I can be of any further assistance in the interim, please do not hesitate to contact me.
