Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available

DECLARATION OF UNIT OWNERSHIP
OF ORIENTAL WEST
CONDOMINIUMS
THIS DECLARATION is made this 'LR P__ day of
September, 1986, by CLEMENT A. PAFFE, JR., and wife, JOYCE A.
PAFFE, residents of Pamlico County, North Carolina „ pursuant to
Chapter 47A of the North Carolina General Statutes.,

WHEREAS, the Developer is the owner of Th ()Verty
described on Exhibit A attached hereto; and,
WHEREAS, the Developer desires to subject The Property
to the provisions of the North Carolina Unit Ownership Act.
NOW, THEREFORE, the Developer hereby subjects The
Property to the provisions of Chapter 47A of the North Carolina
General Statutes and hereby publishes its plan as to the
division of The Property, the imposition of restrictive and
protective covenants, conditions, restrictions, reservations,
liens, agreements and charges thereon, and the individual owner-
ship thereof, and hereby specifies that this Declaration shall
constitute restrictive and protective covenants, conditions,
restrictions and reservations which shall run with The Property
and shall bind and inure to the benefit of the Developer, their
heirs, successors and assigns, and all subsequent owners of any
interest in The Property, their heirs, successors and assigns.
ARTICLE I
DEFINITIONS
As used in this Declaration, unless the context
otherwise requires, the following definitions shall prevail:
(a) Act shall mean and refer to Chapter 47A of
the North Carolina General Statutes.
(b) Articles of Incorporation shall mean the
Articles of Incorporation of the Association.

(c) Association shall mean Oriental West
Condominiums Association, Inc.
(d) Association Properties shall mean such
properties as are owned by the Association from time to time.
(e) Board of Directors shall mean the Board of
Directors of the Association.
(f) Building shall mean a structure containing
in the aggregate two or more Units and comprising a part of the
Condominium Complex. ?fin
(g) Bylaws shall mean the Bylaws of the
Association. tip y
(h) Common Areas shall mean all of The Proper.
and improvements thereon with the exception of Units and shall
include Limited Common Areas.
(i) Common Expenses shall mean all expenses of
administration, maintenance, repair or replacement of Common
Areas, the expenses agreed upon as Common Expenses by the
Association, and such other expenses as may be declared to be
Common Expenses in this Declaration.
(j) Common Profits shall mean the excess of all
receipts of the Association including, but not limited to,
assessments, rents, profits and revenues on account of the
Common Areas, over and above the Common Expenses.
W Condominium Complex shall mean The Property
and all improvements thereon.
(1) Declarant shall mean, collectively, Clement
A. Paffe, Jr., and wife, Joyce A. Paffe.
(m) Limited Common Areas shall mean those Common
Areas reserved for the use of the Unit Owner of a certain Unit
to the exclusion of all other Unit Owners.
(n) Management Agreement shall mean any agree-
ment between the Association and any entity providing for the
management of any property within the Condominium Complex.

Questions: The application calls for 17 slips. The plat of the area surveyed by Dennis Fornes and the hand
drawn rendering both show only 14 slips and dinghy dock at present.
Which number is correct and where are the new slips to be if the 17 number is correct?
As you will note from the Dennis Fornes plat, several of the present slips encroach on the riparian boundary
of my property line at 301 Midyette Street. I have questioned this previously.
The location of the Oriental Condos as shown on the copy of the Town of Oriental map is on the N. C.
Wildlife Commission property's boat access.
I cannot make out just where the dredging is to be done, but I strongly request that the spoil be carefully
contained during the operation so that it will not drift over beneath the slips and turning area at my pier.

Thank you for the inquiry! You note that you received a copy of the proposal on November 101h. The applicant has
submitted delivery confirmation for October 10, 2009. The General Permit (#54692C) for maintenance excavation was
then issued ten (10) days later and is set to expire on May 1, 2011.
I believe that the applicant had erroneously sent you a full CAMA Major Permit application, when in fact the DCM
district staff had made the determination that this project met the General Permit standards instead. This General
Permit only addresses the excavation aspect of the proposed development.
I do understand, from conversing with Mr. Baskerville, that the Oriental West COA does wish to reconfigure the marina
sometime in the near future as well. The DCM will evaluate that proposal when it is received. If I can be of any further
assistance in the interim, please do not hesitate to contact me.
