(Dylan Ray photo) Firefighters contained the fire that was supposed to be a yard debris burn, as set out in a permit officials say was issued. Instead, paint cans, vinyl, fiberglass and furniture were added, which aren't allowed by state law to be burned. County Fire Marshal Ben Barnett said this morning that the investigation into the incident continues and no charges have been filed. County officials contacted the N.C. Department of Environment and Natural Resources in Wilmington and officials from the Water Quality Control division were on scene to test the water for possible contamination. "Water Quality was on scene yesterday and took numerous water samples that will be sent to the State Bureau of Investigation lab in Raleigh," said the fire marshal. "It will be several weeks before the results will be available." He added that the Division of Water Quality would also be contacting local shell fishermen if it is determined the area needs to be closed due to water pollution. A fire call went in about 10 a.m. reporting a debris fire at the end of Marshallberg Road. But when Marshallberg Volunteer Assistant Fire Chief Tom Mann and Capt. Margaret Riggs arrived, they found the burning materials included paint cans, gas cans, fiberglass and vinyl, all considered hazardous materials. Some of the cans in the burning debris exploded, sending projectile metals skyward. They immediately called for mutual aid from Harkers Island, Otway and Davis fire departments telling them to bring tankers and the manpower to assist in containing the burn. County Emergency Services Director Jo Ann Smith and Communications Director Tony Spencer also responded, along with the county's mobile disaster unit. According to Capt. Riggs, Crossroads BP at the intersection of Highway 70 and Harkers Island Road issued the burn permit. The permit indicated that only natural fuels, such as paper, wood and grass, could be burned legally. That's not what fire officials came across. As the flames began to dwindle, firefighters sprayed the debris with foam to smother the remaining embers. Fire Marshall Barnett said he is still investigating to determine exactly who set the debris on fire and who got the permit. He said all agents distributing N.C. Forest Service permits, such as stores and gas stations like Crossroads, have the burning guidelines explained to them so they can tell those getting the permits what they can, and can't burn. County Ranger Don Meadows pointed out on the permit where it stated, "the fuels burned shall consist of leaves, grass clipping, vegetative debris and small branches. Under no circumstances shall anything other than plant growth be burned." He said a permit could also be obtained from the N.C. Division of Forest Resources Web site if someone couldn't get to a permit distributing site. Ranger Meadows said he plans to re-educate those who issue permits about the regulations.
