Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

TRACT ONE: Fee simple title to that strip of land ten

designated on said map as "PIEROWNERS PROPERTY
TRACT TWO: Fee simple title to the wooden pier and
11 pilings adjacent to TRACT ONE above as shown
on the above -referenced map and having the same

Grantors reserve in themselves and their heirs and

1. The right to assign or convey the exclusive right
of use to the ten (10) boatslips or any additions
thereto, to lot owners in Neuse Winds Subdivision,

which the exclusive right to use such Boatslip is appurtenant
have been paid in full. Except for transfers to the Declarant,
an exclusive right to use a Boatslip may only be severed from a
Lot and transferred to another Lot in said Subdivision by deed to
the owners of the other Lot, which deed specifically:
A. Recites that the owners of the Lot from which
the exclusive right to use such Boatslip is being severed release
all rights and privileges granted them by any deed;
B. Designates the Lot in the Subdivision to which
the exclusive right to use the Boatslip is now to be appurtenant;
and
C. Recites that the Lot and the owner of the Lot
to which the exclusive right to use the Boatslip is to now be an
appurtenance shall be subject to all the limitations, provisions,
restrictions and conditions contained herein.

(9) The prospective owner of Lot 30 in the Subdivision
is hereby restricted against the construction_ of any other piers
or other structures into the adjacent waters of Orchard Creek
without the express written permission of the Declarant, and by
acceptance of title to Lot 30 subject to all the terms and
conditions contain herein, such owner shall be deemed to have
waived, relinquished and released all rights to the construction
of additional piers. In addition, it is hereby agreed that the
Board of Directors shall have the exclusive right and
jurisdiction to approve and grant permission for all improvements
to the Property, including, but not limited to, CAMA permits. j

" GENERAL PROVISIONS
(1) The Association, or any member, shall have the
�i right to enforce, by any proceeding at law or in equity, all
+� restrictions, conditions, covenants, reservations, liens and
charges now or hereafter imposed by or under the provisions of
this Declaration. Failure of the Association or any member to
enforce any covenant or restriction herein contained shall in no
event be deemed a waiver of the right to do so thereafter.
(2) Invalidation of any one of these covenants or
J restrictions by judgment or court order shall in no way effect
