The current pipes are failing and need to be replaced to ensure safe public travel. The existing pipes (2 @ 40' x 60" x 46" CMAP) will be replaced with the proposed pipes (2 @ 40' x 66" x 51" CAPA) with aluminum headwalls on each end. The Division of Coastal Management considers the project area to be within an AEC that requires authorization for the pipe replacement. Included with this request are the MP-1, MP-5 forms, location map, landowner notices, and permit drawings depicting the proposed work. WBS element # is 113.209411. This pipe is located in a stream that the Division of Coastal Management claims jurisdictional as Public Trust waters. The existing pipes are (2) 40' X 60" X 46" Corrugated Metal Arch Pipes and will be replaced with (2) 40' X 66" X 5 1 " Corrugated Aluminum Pipe Arches with aluminum headwalls on each end. All work will be within NCDOT right-of-way. The Division of Coastal Management (DCM) considers this water body "Public Trust Waters" under their regulations. Therefore, it is provided protection under state law. For this reason the NCDOT will apply for a permit from the DCM to perform the described work. Part of the permit process is notifying the adjacent landowners of the proposed work. A map depicting the project area, the permit application, and a design plat is included with this letter.
