The North Carolina Department of Transportation (NCDOT) proposes to replace five bridges on NC304 in Pamlico County (Figure 1). Please accept this letter as a request for a Coastal Area Management Act (CAMA) General Permit for the above referenced projects. NCDOT plans to replace these bridges using staged construction and roadway approach work will be kept to a minimum so that one lane of traffic can be maintained on site during construction. The five bridges are being replaced because they have been deemed structurally deficient. The new bridges will be built to match existing alignments and parameters on current locations. Each of the existing bridges has a superstructure composed of a reinforced concrete deck on timber joists. End bents and interior bents are timber caps on timber piles. The existing bridges will be removed in accordance with the NCDOT Best Management Practices for Bridge Demolition and Removal (BMP BDR). The timber and steel components will be removed without dropping any components into Waters of the U.S. MAILING ADDRESS: 113 AIRPORT DRIVE SUITE 100 EDENTON, NC 27932 TELEPHONE: 252-482-7977 FAX: 252-482-8722 WEBSITE: WWW.DOH.DOT.STATE.NC.US LOCATION: 113 Airport Drive Suite 100. It will also be at approximately the same elevation as the existing roadway. Deck and roadway drainage will be maintained at approximately the same slopes as the existing structure and roadway approaches. No deck drains are included in the project. The bridges are all located within the Neuse River Basin and US Geological Survey hydrologic unit 03020105. The North Carolina Division of Water Quality (NCDWQ) has designated a best usage classification for each stream and its unnamed tributaries (UT) as shown in Table 2. Table 2. NCDWQ Index Number and Best Usage Classification Stream Name DWQ Index Number Best Usage Classification Vandemere Creek 27-150-15 SC Sw — NSW Little Vandemere Creek 27-150-15-1 SC Sw — NSW HQW Bear Creek 27-150-28 SA HQW - NSW Gale Creek 27-150-31 SA HQW - NSW UT to Jones Bay 27-152 SA HQW - NSW There are currently no outstanding resource waters (ORW) or drinking water supply waters (WS -I and WS -II) within a one mile radius of the project study area. The 2008 Draft 303(d) list (dated January 10, 2008) or the 2006 Final 303(d) list (dated June 19, 2007) indicates impaired waters located within one mile upstream or downstream of Vandemere Creek, Bear Creek, and Gale Creek are due to fecal coliform contamination. Jurisdictional wetlands are located immediately adjacent to the existing bridges. Avoidance and minimization measures have been incorporated to the extent possible; however, impacts to jurisdictional resources will occur. Permanent impacts to coastal wetlands include fill materials required for widening approach roadways at new end bent locations, which is necessary to conform to current design standards and to accommodate guardrail installation. Permanent surface water impacts include placement of interior bent bridge supports in the channel and rip - rap for fill slope stabilization at new end bent locations. Page 3 March 6, 2009 Existing relic wood pilings located in the water at the bridge locations will be pulled out of the channel because they pose a safety hazard. Sediment curtains will be used to ensure that sediment releases from this activity will be contained to the immediate location of the pile removal operation. Construction equipment will be operated from the existing road surface and/or upland areas and will not enter wetland areas. As of January 31, 2008, the U.S. Fish and Wildlife Service (USFWS) list of protected species includes six federally protected species for Pamlico County (Table 3). Table 3. Federally rotected species listed for Pamlico Coun Appropriate habitat for shortnose sturgeon is available within waters of the five bridge replacement sites. According to NCNHP Virtual Workroom records, updated on September 23, 2008, shortnose sturgeon has been observed in waters of the Neuse River and Pamlico Sound south of Pamlico County. Shortnose sturgeon is a mobile species that is expected to relocate to avoid construction activities; therefore, project construction may affect, but is not likely to adversely affect, this species. There are no viable options for use of an off-site detour and existing traffic must be maintained on one lane during bridge construction. NCDOT requests relief from moratoriums on in -water work to allow completion of this project concurrent with the four adjacent bridge sites along NC 304. Work can be completed in one construction season which will cause minimal disruption to public school bus traffic. PO Box 33127 Raleigh, NC 27636 Dear Ms. Carr: I apologize for our late response to your letter of November 6, 2008, requesting for Advance Permit Approval for the following North Carolina Department of Transportation Bridge Replacement Projects in Pamlico County, NC: 1) B -5129B, Bridge No. 31 over Vandemere Creek; 2) B -5129C, Bridge No. 35 over Little Vandemere Creek; 3) B -5129D, Bridge No. 40 over Bear Creek; 4) B -5129E, Bridge No. 42 over Gale Creek; and 5) B-4594, Bridge No. 44 over Jones Bay Our examination and historical data indicate that there is sufficient factual support for concluding that these waterways are navigable waters of the United States. However, the waterways also meet the criteria for advanced approval waterways outlined in Title 33, Code of Federal Regulations, Section 115.70. Advance approval waterways are those that are navigable in law, but not actually navigated by other than small boats. The Commandant of the Coast Guard has given his advance approval to the construction and rehabilitation of bridges across such waterways. Therefore, a Coast Guard Bridge permit will not be required for these proposed bridge replacement projects. These projects will be placed in our Advance Approval category for the locations and replacement of the Abovementioned Bridge projects and is valid for five years from the date of this letter. If the construction does not commence within this time period, you must contact this office for reaffirmation of this authorization. Future bridge projects along the same waterways will have to be independently evaluated before they may be considered for Advance Approval. The fact that a Coast Guard bridge permit is not required does not relieve you of the responsibility for compliance with the requirements of any other Federal, State, or local agency who may have jurisdiction over any aspect of these projects. Although these projects will not require a bridge permit, other areas of Coast Guard jurisdiction apply. The following must be met: From: 7573988334 _Pale: 3f3 Date: 2./119120093:416:20 PM , y 16591 19 FEB 09 a. The lowest portion of the superstructure of the bridge across the waterway should clear the 100 -year Hood height elevation, if feasible. b. The National Ocean Service (NOS) of the National Oceanic and Atmospheric Administration (NOAA) is responsible for maintaining the charts of U.S. waters; therefore they must be notified of these proposed bridge projects. You must notify our office and the NOS upon completion of the activities approved in this letter. Your notification of completion must include as -built drawings, which certifies the location and clearances of the each bridge that was constructed. Easley, Governer Division of Marine Fisheries Dr. Louis B. Daniel III, Director ".Villiatn G. Ross Jr., Secretary MEMORANDUM TO: John Rouse THROUGH: Anne Deaton FROM: Sean McKenna DATE: December 23, 2008 SUBJECT: Request for comments on NCDOT Pamlico County Bridge Replacement Projects. The following comments by the North Carolina Division of Marine Fisheries (NCDMF) on the replacement of the subject bridges are offered pursuant to G.S. 113-131. Bridge numbers 35 (Little Vandemere Creek), 40 (Bear Creek), 42 (Gale Creek), and 44 (UT to Jones Bay) cross Primary Nursery areas, and the NCDMF requests that NCDOT impose an in - water work moratorium from April 1 through September 30. Additionally, the NCDMF requests that the replacement bridges span high ground to high ground; deck drains should not discharge directly into the stream; uncured concrete should not contact the water in or entering the stream; and that the NCDOT utilize sedimentation and erosion control measures to protect aquatic resources. While Vandemere Creek (bridge No.31) is not a Primary Nursery area, there are numerous Primary Nursery Areas located downstream of this site. All care must be taken to protect these critical habitat areas. The NCDMF requests that NCDOT take a risk adverse approach to this project and impose an in -water moratorium from April 1 through September 30, and follow the other aforementioned guidelines. 3441 Arendell Street, P.O. Vandemere Creek (B -5129A Bridge No. 31) is the only low -salinity stream (salinity = 1.3 ppt) and this bridge crossing is a boundary between inland and coastal - waters, so downstream impacts would affect waters under jurisdiction by Division of Marine Fisheries. With the exception of Vandemere Creek, the rest of the bridges cross very saline waters and downstream impacts would affect coastal fishing waters (all of which are designated as PNA's by DMF)............ 0 -----Original Message ----- From: Travis Wilson[ma iIto: travis.wiison@ncwiIdIife.org] Sent: Monday, December 01, 2008 4:17 PM To: Barwick, Bob Subject: bridge replacements Comments? Review of the applications indicate that 3 of the 5 bridges do not qualify for the general permit. As you are aware, the general permit allows a maximum of 500 square feet of wetland impacts. Bridges 31, 42, and 44 exceed that amount and will have to be processed under a major permit application as they are currently proposed. Additionally, there are minor corrections needed to the drawings and MP -5 forms for Bridge 35 and Bridge 40. To obtain general permits for the projects the following items need to be addressed: Bridge 31 1 Reduce wetland impacts to under 500 sq. ft. 2 Revise MP -5 Section 3 items (e),(f),(g) Bridge 35 1 Correctly show extent of causeway removal areas 2 Revise MP -5 Section 3 items (e),(f),(g) Bridge 40 1 Correctly show extent of causeway removal areas in cross section and plan view 2 Correctly show marsh and stream in area of existing dock 3 Revise MP -5 Section 3 items (e),(f),(g) Bridge 42 1 Reduce wetland impacts to under S00 sq. ft. 2 Correctly show marsh and stream in area of wetland impact area W-1. 3 Revise MP -5 Section 3 items (e),(f),(g) Bridge 44 1 Reduce wetland impacts to under 500 sq. ft. 2 Correctly show extent of causeway removal areas in cross section 3 Revise MP -5 Section 3 items (e),(f),(g) Some of the information listed above can possibly be corrected over the phone, however, the biggest obstacle is the wetland impacts being over 500 square feet. I have visited the sites and have tried to figure out how to help you fit the projects under the general permit process. I have some possible recommendations that may help in this regard. Please call me when you get a chance so we can discuss this further. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Avoidance Measures: Existing roadway and bridge alignment will be maintained during staged construction and an on-site detour will avoid need for a temporary detour bridge by using a portion of the existing bridge to maintain traffic flow. The new structure will be constructed using pre-cast concrete components which avoids potential impacts from live concrete. During demolition, components of the existing bridge will not be dropped in the water. Sediment curtains will be used around relic pylons to prevent sediment from entering the water column. Minimization Measures: Wetland impacts have been minimized to the extent feasible, with impacts occurring only where new location of bridge bents and piers are required to support the structure and installation of safety guard rails. Existing roadway and bridge alignment have been maintained to minimize impacts. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Use of the existing roadway to maintain traffic on-site during construction of the new bridge. Use of existing roadway to operate construction equipment; no equipment will enter wetlands or waters. Use of pre-cast concrete bridge components avoid use of live concrete. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a.
