The North Carolina Department of Transportation (NCDOT) proposes to replace five bridges on NC304 in Pamlico County (Figure 1). Please accept this letter as a request for a Coastal Area Management Act (CAMA) General Permit for the above referenced projects. NCDOT plans to replace these bridges using staged construction and roadway approach work will be kept to a minimum so that one lane of traffic can be maintained on site during construction. The five bridges are being replaced because they have been deemed structurally deficient. The new bridges will be built to match existing alignments and parameters on current locations. Each of the existing bridges has a superstructure composed of a reinforced concrete deck on timber joists. End bents and interior bents are timber caps on timber piles. The existing bridges will be removed in accordance with the NCDOT Best Management Practices for Bridge Demolition and Removal (BMP-BDR). Edenton, NC 27932 Page 2 March 6, 2009 The recommended replacement structure for each bridge is a concrete cored slab deck with a clear roadway width of 33 feet. Table 1 shows the existing bridge length and the proposed bridge length for the five bridge replacements. Table 1. It will also be at approximately the same elevation as the existing roadway. Deck and roadway drainage will be maintained at approximately the same slopes as the existing structure and roadway approaches. No deck drains are included in the project. The bridges are all located within the Neuse River Basin and US Geological Survey hydrologic unit 03020105. The North Carolina Division of Water Quality (NCDWQ) has designated a best usage classification for each stream and its unnamed tributaries (UT) as shown in Table 2. Table 2. The 2008 Draft 303(d) list (dated January 10, 2008) or the 2006 Final 303(d) list (dated June 19, 2007) indicates impaired waters located within one mile upstream or downstream of Vandemere Creek, Bear Creek, and Gale Creek are due to fecal coliform contamination. Jurisdictional wetlands are located immediately adjacent to the existing bridges. Avoidance and minimization measures have been incorporated to the extent possible; however, impacts to jurisdictional resources will occur. Permanent impacts to coastal wetlands include fill materials required for widening approach roadways at new end bent locations, which is necessary to conform to current design standards and to accommodate guardrail installation. Permanent surface water impacts include placement of interior bent bridge supports in the channel and rip - rap for fill slope stabilization at new end bent locations. Page 3 March 6, 2009 Existing relic wood pilings located in the water at the bridge locations will be pulled out of the channel because they pose a safety hazard. Sediment curtains will be used to ensure that sediment releases from this activity will be contained to the immediate location of the pile removal operation. Construction equipment will be operated from the existing road surface and/or upland areas and will not enter wetland areas. As of January 31, 2008, the U.S. Fish and Wildlife Service (USFWS) list of protected species includes six federally protected species for Pamlico County (Table 3). Table 3. Federally protected species listed for Pamlico County. Appropriate habitat for shortnose sturgeon is available within waters of the five bridge replacement sites. According to NCNHP Virtual Workroom records, updated on September 23, 2008, shortnose sturgeon has been observed in waters of the Neuse River and Pamlico Sound south of Pamlico County. Shortnose sturgeon is a mobile species that is expected to relocate to avoid construction activities; therefore, project construction may affect, but is not likely to adversely affect, this species. There are no viable options for use of an off-site detour and existing traffic must be maintained on one lane during bridge construction. NCDOT requests relief from moratoriums on in -water work to allow completion of this project concurrent with the four adjacent bridge sites along NC 304. Work can be completed in one construction season which will cause minimal disruption to public school bus traffic. The following information is provided for each of the bridge replacement projects: CAMA permit forms MP -1, MP -2, and MP -5; U.S. Postal Service Return Receipt certification cards from adjacent landowner notification packages; Pre -Construction Notification Form; permit drawings; and Figures 1 and 2 which identify the project sites. We are requesting that the proposed work be authorized under a CAMA General Permit. By copy of this letter we are also requesting issuance of a US Army Corps of Engineers Nationwide Permit 14 and the corresponding 401 General Certification 3704. However, the waterways also meet the criteria for advanced approval waterways outlined in Title 33, Code of Federal Regulations, Section 115.70. Advance approval waterways are those that are navigable in law, but not actually navigated by other than small boats. The Commandant of the Coast Guard has given his advance approval to the construction and rehabilitation of bridges across such waterways. Therefore, a Coast Guard Bridge permit will not be required for these proposed bridge replacement projects. These projects will be placed in our Advance Approval category for the locations and replacement of the Abovementioned Bridge projects and is valid for five years from the date of this letter. If the construction does not commence within this time period, you must contact this office for reaffirmation of this authorization. Future bridge projects along the same waterways will have to be independently evaluated before they may be considered for Advance Approval. The fact that a Coast Guard bridge permit is not required does not relieve you of the responsibility for compliance with the requirements of any other Federal, State, or local agency who may have jurisdiction over any aspect of these projects. Although these projects will not require a bridge permit, other areas of Coast Guard jurisdiction apply. The following comments by the North Carolina Division of Marine Fisheries (NCDMF) on the replacement of the subject bridges are offered pursuant to G.S. 113-131. Bridge numbers 35 (Little Vandemere Creek), 40 (Bear Creek), 42 (Gale Creek), and 44 (UT to Jones Bay) cross Primary Nursery areas, and the NCDMF requests that NCDOT impose an in - water work moratorium from April 1 through September 30. Additionally, the NCDMF requests that the replacement bridges span high ground to high ground; deck drains should not discharge directly into the stream; uncured concrete should not contact the water in or entering the stream; and that the NCDOT utilize sedimentation and erosion control measures to protect aquatic resources. While Vandemere Creek (bridge No.31) is not a Primary Nursery area, there are numerous Primary Nursery Areas located downstream of this site. All care must be taken to protect these critical habitat areas. Review of the applications indicate that 3 of the 5 bridges do not qualify for the general permit. As you are aware, the general permit allows a maximum of 500 square feet of wetland impacts. Bridges 31, 42, and 44 exceed that amount and will have to be processed under a major permit application as they are currently proposed. Additionally, there are minor corrections needed to the drawings and MP -5 forms for Bridge 35 and Bridge 40. This form allows the adjacent riparian landowner to express either: (1) that he objects to the project; or, (2) that he does not object and desires to waive his/her right to the 10 -day period so that the processing of the application can progress more rapidly. Of course, the adjacent riparian landowner need not sign this form at all if he/she so chooses.
