Permittee shall not discriminate, against any person or persons because of race, religion, color, sex, age, or national origin, in the conduct of its operation under this permit or other authorization. 2. Permittee agrees to exercise the privileges granted in this permit, subject to the supervision of the representatives of the North Carolina Department of Environment, Health, and Natural Resources and in accordance with all rules and regulations of the Department. 3. Permittee agrees to comply with all Federal laws and regulations and all the laws, ordinances, and regulations of the State, County, and municipality where in the said premises are located, with regard to construction, sanitation, licenses, or permits to do business, and all other matters. 4. Permittee agrees to keep the buildings and grounds clean and in a sanitary condition. It shall particularly be the responsibility of the permittee to leave the buildings, grounds, equipment and facilities'*in a clean and orderly condition at end of occupancy. The right is reserved to charge a clean-up or repair fee if this is not done. Upon the expiration or termination of this permit, the said premises shall be delivered up in as good repair and condition as the same are, in at beginning of occupancy. S. No timber, tree, or shrub shall be cut, damaged or destroyed, nor shall any other natural feature be damaged or destroyed. 5. No building or structure shall be altered, erected or constructed except as specified as a condition of this permit. 7. Permittee shall use said premises only for authorized recreational purposes, and shall not operate, or permit to be operated, any concession or profit making enterprise which involves the sale of goods, Tood, merchandise or other article or commodity to the general public, unless authorized by this permit. $. Permittee shall not 'transfer or assign this permit, nor sublet said premises or any part thereof or grant use of any part of this permit to persons not subject to this permit. 4. Permittee shall and hereby does waive and release any ands all claim against the North Carolina Environment, Health and Natural Resources Department or its employees, or the State of North Carolina for any and all damages, loss, cost to person or property arising either directly or indirectly from the use of said premises and/or from the exercise of the privileges granted by this permit. 10. permittee shall take proper steps to provide for the health and safety of participants on said premises. 11. Permittee shall, prior to exercising any rights herein granted, submit a master traffic pattern for the direction and care of vehicular access and parking if required by the site Park Superintendent. 12. The site Park Superintendent, Division Chief of Operations, or their designated representative shall have authority to revoke this permit and require removal of any equipment upon failure of the permittee to comply with the terms and/or conditions of the permit. In the event a permit is revoked the fee is non-refundable. 13. The site previously used for the movie "Weekend at Bernie's" will be used. The site boundaries will be identified by the Park Superintendent. 15. Permittee agrees to compensate the State of North Carolina for any overtime accrued during filming, as required by the North Carolina Division of Parks and Recreation Filming Guidelines. Compensation/fee will be assessed at the conclusion of filming. Park Superintendent will advise permittee when and/or if overtime will be necessary. 16, Vehicles will be allowed north of Crossover #1 at time agreed upon and approved by the Park Superintendent; vehicles will not be allowed north of the filming location. 17. Permittee will provide unarmed security personnel sufficient for the supervision of the site and equipment when not in use. 18. Activities that violate any North Carolina Parks and Recreation Regulations may not be filmed without the approval of the Park Superintendent. Public nudity and use of firearms are of particular concern. 19. Permittee will be allowed to use the northern half of the Fort Fisher State Recreation Area parking lot. Additional space may be allowed at the discretion and upon approval of the Park Superintendent during week days as long as sufficient space remains for park visitor use. 20. An appropriate number of portable toilets should be brought to the park by the filming company for the construction and filming phases of the project, Placement location to be determined by the Park Superintendent. 21. Permittee will insure minimum disruption of public visitation and recreational activities. All four-wheel access roads (i.e., crossovers) will remain open to park visitor traffic during set construction. Permittee is allowed to restrict and/or block access across crossovers #1 and #2 and to restrict traffic and park use, as reasonably necessary, only during actual filming and other critical production activities. During these times Permittee will be allowed to direct pedestrians and vehicles away from the filming area. Permittee agrees to limit these times as much as possible. 22. The Park Superintendent has full enforcement authority on any conditions established and agreed to in this permit and approval of any changes requested by the permittee. 23. The permittee, their employees, and contractors will observe and abide by all park rules and regulations and any special conditions specified by the Division of Parks and Recreation. 24. No other park areas will be disturbed without notification and prior approval of the Park Superintendent. 25. The siting and use of any heavy equipment will be coordinated with the Park Superintendent prior to its arrival and any relocation will be approved by the Park Superintendent. 26. Electrical power to the filming site is the sole responsibility of the permittee and the location of any temporary lines and poles will be approved in advance by the Park Superintendent. The removal of all temporary installations will be the responsibility of the permittee. 27. All lights used for construction, security, or filming will be effectively -shielded from the beach. 28. All litter, debris, and other waste materials will be picked up or cleaned up daily. It will be disposed of, off -site, at least weekly or when directed by the Park Superintendent. 29. Permittee will provide personnel to act as turtle nest attendants when night filming takes place during a potential hatching period. Park Superintendent will be notified at least three days prior to any scheduled night production - permittee will be notified if a "TNA" will be required. 30. No unlicensed vehicles will be permitted outside the confines of the designated and approved production site. 31. The permittee will meet with the Division staff immediately after wrap-up to evaluate the impact of the filming activities and development of a restoration plan. 32. The permittee will insure complete restoration of the area to the satisfaction of the Park Superintendent and Natural Resource Management staff - all damaged vegetation will be replanted, all foreign materials will be removed, all roads and accesses used will be restored to their original conditions, all dunes will be restored to their original topography; any planted material should live through two growing seasons. 33, All filming and production work will be completed no later than November 6, 1995. The production site and other park facilities will be vacated by the permittee within two weeks after this date. 34. Permittee has been informed and understands that three special events are scheduled for the Fort Fisher State Recreation Area during the filming and construction period covered by this permit. Permittee also understands that these public events cannot be unreasonably altered or interfered with by the activities granted under the conditions of this permit. L'__ i_&P.n-temher 16. A bond or rash deposit in the amount of $5,000 (Five Thousand Dollars and no/100) will be required upon the issuance of this permit and must be received by the Division of Parks and Recreation before the permit may be considered valid. A performance bond issued by a bonding company, a cash deposit or certified check may be used for this purpose. Should the permittee actually fail to perform all or any part of the necessary cleanup or restoration required under this permit, the Park Superintendent will have the required work done, assess the change, deduct it from the bond or cash deposit and return the balance, if any, to the permittee, 36. The permittee will provide proof of General Liability Insurance sufficient to protect the State and its employees from claims or litigation connected with injury or damage resulting from the actions of the permittee or his agents and employees. 37. Resident wildlife may be photographed, but only when such wildlife is not molested, harmed, or disturbed thereby. Wildlife captured elsewhere may not be used in filming, whether trained or not. Domestic animals may be used if humane treatment is maintained at all times. 38, Photographers and crews must comply with any special instructions from the official in charge of the park. 39. No employee of the Division of Parks and Recreation may work for the permittee in any capacity while in uniform or if directly involved in the supervision of the permittee. 40, No personal gratuity of any nature will be offered to any governmental employee in connection with the exercise of the privilege granted under this permit, 41. Park staff will supervise filming within park boundaries, and will have the authority to make all supervisory decisions to insure compliance with the permit and applicable regulation. 42, The permittee shall be required to comply with all regulations of the Department of Environment, Health & Natural Resources, the Division of Parks and Recreation, and all Federal, State, County and municipal laws, ordinances or regulations, 43, If the Director of Parks and Recreation or his designee finds that Permittee hag taken actions that threaten resources or facilities, or otherwise finds that Permittee is not operating within the conditions of this Permit, the Director or his designee shall so notify the Permittee in writing.
