This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
i
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
jadjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

Dear Ms Rice:
Please find enclosed CAMA General Permit #13989 which was issued to Mr. Richard Myers
to construct a pier with mooring pilings at his property locatd off NCSR 1330 and on the north
end of Rice Avenue, near the community of Florence, Pamlico County. This permit was issued
after evaluating your concerns and the projects consistency with Coastal Resource Commission
rules. If you wish to request an appeal of this permit decision, you must do so within 20 days
of permit issuance. Please contact me and I will supply you with the appropriate third party
appeal form you will need to make your request.
If you have any questions concerning this, please contact me at my Morehead City office.

Candi and I appreciate your time on Memorial Day to look at our property on the Bay
River. We are interested in constructing a pier 100-150 ft. into the river and also want to protect
the shoreline extending from the pier, Southeast to the corner of our lot. We have enclosed a
signed application for a C.A.M.A. Minor Permit along with a check for $50. We verified the
names and addresses of the adjacent property owners per the Pamlico Co. Register of Deeds. We
left the remainder of the application blank trusting that you will better know what is needed.

Dear Mr. Joyce,
We are in receipt of your letter dated August, 9th, 1994.
Subsequent to this, you were advised by phone conversation that
family illness prevented a prompt reply to your request. We are
thanking you again for your consideration.
As stated in your letter, you are acting consultant for the Myers,
and are requesting that Ms. Rosa Rice "adjacent property owner and
holder of the deed of easement located on the lot owned by the Myers
which consist of a twenty -foot recreational easement recorded in
Pamlico County to Rosa Rice and heirs in fee simple", sign a
Riparian Property Owner Statement (for a pier) as sketched in your
request to CAMA.
As you were made aware in phone conversation, there are some concerns
surrounding the integrity and protecting the original intent of usage
of that twenty -foot easement held by Mr. Rosa Rice. And the eventual
intent to upgrade and utilize this easement under state guidelines.
Your proposal causes some concern as to the placement of the Myers pier
and any eventual intent to erect a similiar pier parallel and same in
physical size by Rose Rice and heirs. It is our contention that all
partys would be better served if the Myers pier took a Northwesterly (NW)
route from their property and be in line with EXISTING piers. This
direction suggested, would be termed "up the river" toward Bayboro.
Your proposal would limit the right of the Rice easement., limiting navi-
gable waters and reduce proper egress and ingress to public waters by
way of the recreational easement. To re -position the proposed Myers pier
as we suggest, would provide them deeper water access and not obstruct
their view from their home. Our proposal is intended to protect the rights
of all partys and not a few.
Mr. Joyce, please assure the Myers that this is nothing personal directed
towards them, regrettably through no fault of their own, the chain of
events of how this property was obtained by Mr. Frank Spain (seller)
from Ms. Rice, its intern usage, a septic permit that was denied, only
to be revised to accomodate the sell of the property.by Mr. Spain, and
ultimately the re -deeding of the easement to Rosa Rice and heirs after
is was discovered and legal action was threatend against Mr. Spain.
And a host of discrepancys that Mr. Spain would prefer be forgotten.

a proposed dock placement in a direction that will accomodate every-
one concerned.

The purpose of this letter is to inform you that your
neighbors, the Myers, are wishing to build a dock in front of
their lot in the Florence community. We are enclosing a plot
plan of the Myer's lot with a layout of the lot to include
the proposed pier and shoreline ine cover. We hope their plan
meets with your approval and that you have no objection.
We are the Myer's Consultant for the small project and have
met on site with the State CAMA office to discuss the
proposed pier and rip rap shoreline cover. The State CAMA
office has no objection to the proposed work and has flagged
the amount of shoreline that may be covered.
We hope the information provided is satisfactory and answers
any questions you may have concerning the proposed pier.
We are attaching a form "Adjacent Riparian Property Owner
Statement, (For A Pier)" furnished to us by the State CAMA
office for you to sign as part of the permitting process. We
