This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) this pro- ject is consistent with the local land use plan and all local ordinances, and 2) a written statement has been obtained from adjacent riparian landowners certifying that they have no objections to the proposed work. Due to the sideline restrictions pla c n t�eTot you have found it necessary to locate the proposed residence at a point that will impact federal wetlands to a limited extent. We met on site on June 6, 1995 to examine the property. Also present were Mr. Ingram, Mr. Carl Blevins of your firm and Ms. Janet Russell of this Division. During the visit we discussed the minimizing of fill in wetlands. As a part of the major permit review of this project, in which the US Army Corps of Engineers and the Division of Environmental were commenting agencies, our position was that there should be no wetland fill in addition to that authorized by the permit. However the restrictions placed on the property by the sideline restrictions were not evaluated in the original review. A compromise position reached during that visit was the installation of a retaining wal1bulkhead at what turned out to be the storage room line on the house plans. During my additional review of this request, I discovered that the wetland delineation line on the plat plan for Lot 28 did not appear to coincide with the line shown on the master plan. Further investigation of this feature indicated that a 1 " = 30' scale was apparently used to place the wetland delineation line on the plat which appears to be drawn at a 1" = 50' scale. The resulting fill, minus the area protected by the proposed bulkhead, will impact the federal wetland in an irregularly shaped area approximately 25' at the widest point. Apparently the Corps of Engineers and Division of Environmental Management have already approved the project. Based on the new facts and the proposed bulkhead I am recommending that a minor modification to the existing permit be issued in order to allow the Ingram project to be built as proposed including the modification agreed to. We will need a letter from the developers authorizing a change to the permit that was issued for the subdivision. By copy of this letter I am advising them of our position on this matter. A processing fee of $50.00 will be required with your final submittal.
