Any violation of these terms may subject the permittee to a fine, imprisonment or civil action; and may cause the permit to be- come null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) this pro- ject is consistent with the local land use plan and all local ordinances, and 2) a written statement has been obtained from adjacent riparian landowners certifying that they have no objections to the proposed work. C Dear Mr. Stroud; October 22, 1994 Coastal Management 28405 H7 DO U 00GT ? 4 1994 DIVISION OF COASTAL MANAGEMENT Re: General Permit Application notice by Mr. Coble on Lot 36, Section B, Porters Neck Plantation. My wife, Lois P. Furr, owns a waterfront lot (39, Section B), three lots north of the lot Mr. Coble has requested permission to build a new pier. We are concerned about the implication that he can build a pier extending 166 feet out from the mainland without blocking a navigable channel. With reference to EHNR - Coastal Management T15A:07H .1204 (C), .1204 (g), there is a navigable channel much closer to the shoreline than 166 feet. This channel serves Lots 36B, 37B, 38B and 39B. It will be blocked if Mr. Coble is granted a permit to extend a pier 166 feet from shore. We have a sailboat, and my son has a 25 foot Grady White which are dependent on this channel being kept open for access to Lot 39, Section B. We thought this question had been resolved during the Permit Application of the Porters Neck Plantation Homeowners Association to install a ramp at the waterfront of Lot 35A, Section B off of Bald Eagle Lane. At that time a ruling was made that the water access channel which came in close to shore could not be blocked. Aerial photographs of this channel and photographs of the vessels described above should be on file with that Homeowners Application. This aerial photograph as well as on site depth exploration revealed that this inshore channel swings shoreward as it crosses the southern line of Lot 36, Section B, and then exits Lot 36, Section B's Northern line much closer to shore. It appears that this channel location and configuration would define the length of any pier or structure which should be permitted over water between the North and South lines of Lot 36, Section B. A longer pier is possible on the south side than on the north side of Lot 36B. If permissible I would like to be present at any on -site visit your department makes to this site.
