Dear Mr. Rogers:
This is in reference to your letter of December 16, 1994, in which
you have requested a modification of the above referenced permit.
According to your letter you now wish to jet or wash the fiber
optic cable underneath the channel instead of boring. You have
also indicated that the cable would be buried approximately 6'
below the surface of the channel bed.
Please be advised that CAMA General Permit #13823-C is hereby
modified to allow for this type of installation. Please attach
this letter to your permit so that it may be made available to
Department personnel when making routine monitoring inspections of
the project site.
We appreciate you informing us of this change and if you have any
other questions, please contact me at my Morehead City office.

PROJECT: A waterway, 12 feet deep, with width varying from 90 feet in land
cuts to 300 feet in open waters; the construction, operation and
maintenance of suitable bridges; saltwater -intrusion preventive measures,
including a pumping plant and dam, in the vicinity of Fairfield, N.C.; ***a
channel, 6 feet deep, 50 feet wide, to a basin, 5 feet deep, 200 feet
wide, and 600 feet long, in Peltier Creek; **a channel, 6 feet deep, 90
feet wide, to the gorge in Bogue Inlet; thence, 8 feet deep and 150 feet
wide through the inlet; a channel, 12 feet deep, 90 feet wide, to a
turning basin, 12 feet deep, 200 feet wide, and 350 feet long, at
Swansboro; a channel, 6 feet deep, 90 feet wide, through New River Inlet
to the Intracoastal waterway in New River; * a channel, 12 feet deep, 90
feet wide, in New River to the Seaboard Coast Line Railroad bridge at
Jacksonville, N. C., and a basin at Jacksonville of the same depth and
varying in width; **a channel, 8 feet deep, 150 feet wide, through New
Topsail Inlet, thence a channel, 7 feet deep, 80 feet wide, by way of
Banks Channel, paralleling the barrier beach to the Intracoastal waterway
and a channel, 7 feet deep, 80 feet wide, in Old Topsail Creek to the
Intracoastal Waterway; a channel, 14 feet deep, 400 feet wide, across the
ocean bar at Masonboro Inlet, thence 12 feet deep, 90 feet wide, to the
Intracoastal Waterway by way of Banks and Motte Channels; a turning basin,
15 feet deep, 300 feet wide, and 700 feet long, near Masonboro Inlet, with
three 15-pile dolphins therein; a jetty on each side of Masonboro Inlet,
extending to the 14-foot depth in the ocean; ** a channel, 8 feet deep,
150 feet wide, through Carolina Beach Inlet to the Intracoastal Waterway;
modification of Masonboro Inlet navigation Project to mitigate jetty -related
erosion at Wrightsville Beach by placement of dredged sand fill; maintenance
of a channel, 6 feet deep, 80 feet wide, and 8,000 feet long, to a turning
basin, 6 feet deep, 13 feet wide, and 180 feet long, at Carolina Beach
Harbor; ***a tidal lock in the land cut near the Cape Fear River; a boat
basin, 12 feet deep, 230 feet wide, 450 feet long, at the town of Southport;
and maintenance of the general navigation features of the North Carolina
State Ports Authority Small -Boat Harbor at Southport, N.C., consisting of an
entrance channel, 150 feet wide and 400 feet long; an eastern harbor -access
channel, 70 feet wide and 430 feet long; and a western harbor -access channel,
60 feet wide and 185 feet long, to a turning basin, 180 feet wide and 550
feet long; including suitable widening at channel intersections; all to a
depth of 6 feet. Length of channels and basins totals 347.7 miles,
GRES : Complete, except for training wail and three tie-up dolphins at
Masonboro Inlet, and replacement of the three remaining highway bridges with
65 feet high fixed bridges. The new Walter B. Jones (formerly Wilkerson
Creek) Bridge was opened to traffic on July 31, 1981 The Joseph P. Knapp
Bridge (formerly Coinjock) was opened to traffic on November 13, 1986_

Attached hereto, far your files, is a copy of the Right of Way Encroachment Contract
which has been property executed. This contract covers the fbIlowing:
Installation of approximately 4.0 miles of buried fiber optic cable along and under SR
1183, along new NC 101, along old NC 101, under SR 1161 by dry bore, and under
the Intracoastal Waterway Canal in Carteret County per attached drwMngs.
APPROVED SUBJECT TO:
(1) Nottty the District Office (919) 514A716 prior to and upon completion
Of work.
(2) Workmanship and materials to conform to D.O.T. standards and
specifications.
(3) Traffic Control Devices shall be in accordance with the Manual on
Uniform Traffic Control Devices and amendments or supplements
thereto. Proper traffic control devices, signs, etc., shall be installed
to Insure public safety.
(4) Contact the appropriate Utility Company(les) involved and make
satisfactory arrangements to adjust the utilities in conflict with the
proposed work prior to construction.

(5) Any pavement or drainage structure disturbed or damaged shall be
restored to its original condition as directed by the District Engineer.
(6) Trenching, bore pits, and/or other exc avabons shall not be left open or
unsafe overnight
(7) Notify the Dtstrtct O tloe at least 24 hours in advance of performing road
bores. A representative of the District Office must be on site during this
operation.
(I) F"dl areawbackfill shah be compacted to 95% original density. All trenched
material shall be compacted in it layers by mechanical tamp. Any mdwial
removed from the trenchlpit that Is contaminated or unsuitable Ibr baeldiill
shall be disposed of off DOT right of way.
(9) Dress, seed, and mulch all disturbed areas within ten (10) working days from
completion of work.
(1 p) Proper temporary and permanent measures shall be used to control
erosion and sedimentation in accordance with local, State, and Federal
regutOons.
(11) All roadway signs are to be replaced before the end of the same worts day.
(12) Splice bones, manholes, and outer appurtenances shall be located at the
right of way or to not interfere with maintenance activities.
0 3) Cable shall be hand trenched over culverts as shown on the attached
drawings, In cases where less than minimum bury Is necessary or wtwe bores
are greaW then (r. the pipe shall be protected with a casing.
(14) Strict compliance with the Policies and Procedures for Accommodating
UtilIfies on Hghv►sy Rights of Way manual shall be required.
(15) No open cut of pavement will be permitted for this Installation.

SPECIAL_ PROVISIONS
Untrenched Construction
Under no conditions shall jetting or wet boring, with water, of utility pipelines
or encasements under pavements be allowed.
Boring and Jacking
Smooth wall or spiral weld steel pipe may be jacked through dry bores slightly
larger than the pipe bored progressively ahead of the leading edge of the advancing
pipe as spoil is mucked by the auger back through the pipe. As the dry boring
operation progresses, each new section of the encasement pipe shall be butt -welded -
to the section previously jacked into place. Encasements shall extend from ditch
line to ditch line in cut sections, 5' beyond the toe of slopes in -fill sections,
and 3' -behind curb sections.
If voids are encountered or occur outside the encasement pipe, grout holes shall be
installed in the top section of the encasement pipe at 10 foot centers and the
voids filled with 1:3 portland cement grout at sufficient pressure to prevent
settlement in the roadway.
In the event an obstruction is encountered during the boring and jacking operation
the auger is to be withdrawn and the excess pipe is to be cut off, capped, and
filled with 1:3 portland cement grout at sufficient pressure to fill all voids
before moving to another boring site.

Materials, ,joints, protective coating, grouting, wall thickness of carrier pipe,
welds, and cathodic protection shall be in accordance with applicable industry or
governmental codes, as well as the specification of the Department of Transportation.
Casing pipe shall be sealed at the ends to prevent flowing water and debris from
entering the annular space between the casing and the carrier.
The grade of the top of the pipe or casing within rights -of -way should provide
minimum bury as follows:
A. Longitudinal Installations ...................3'

C. Crossings Under Ditches (Paved & Unpaved) .... 2'
Pipelines carrying flammable, corrosive, expansive, energized or unstable transmittants
