The purpose of my letter is to clarify some of the points made in your correspondence and to seek resolution to the issue. The placement of protective sandbags at the Comfort Inn was authorized by the North Carolina Division of Coastal Management by General Permit #13749A issued January 1995. The installation of this emergency work was completed by February 1995 and substantially constitutes the alignment which exists today. On July 14, 2000, Dare II, LLC received your correspondence regarding the provisions that the Coastal Resources Commission (CRC) would allow continued use of these sandbags until May 2008. Your letter of September 5, 2000 extended the compliance deadline and provided guidelines on actions which must be taken to address the alignment. Dare II, LLC retained Environmental Professionals, Inc. (EPI) to coordinate the efforts of engineers, architects and other design professionals to establish a Plan of Action to address the issue. This Plan was submitted to your office on September 28, 2000. As part of this Plan, the sandbag alignment was surveyed, and design professionals offered a schedule which would not only address the actions necessary to comply with the CRC order but also maintain the structural integrity of the building. This Plan was found to be unsuitable to the Division of Coastal Management personnel which was communicated to me verbally. I informed my client of the State's refusal of the Plan of Action which resulted in our meeting of December 8, 2000. You and I met on site and agreed that the removal of the top -most sandbags along the east side of the structure would remove approximately 3 %2 feet of bags in excess of the height limitation. The bags on the north exposure of the building were covered with sand and therefore did not require any modification. Before removal of the bags could commence, support for the deck had to be provided, and this work was completed between Christmas and New Years. The top -most bags were removed during the first part of January. Upon compliance with the agreements made, EPI arranged a meeting with DCM for January 8, 2001 to certify compliance. This meeting was to commence at the office of EPI and evidently the field representative arrived at the site instead of the EPI office. The meeting was rescheduled for January 26, 2001. During the interim, winter storms (northeast winds) occurred on January 12di — 14d' (winds averaging +/- 15 knots) and January 22nd —26`h (winds averaging +/- 19 knots). Erosion at the site and removal of the lower cover of the bags on the north and east sides of the structure occurred during these storm events. We have attached the wind data that was generated from the weather station maintained by EPI which demonstrates the occurrence of storms. Because of the additional exposure of bags on the east and north sides of the structure, the remediation agreed to was not considered sufficient to meet the CRC directives. Since sandbag installation was approved by General Permit and exposure was caused by winter storms, my client believes that it is unfair to require additional removal of bags when sand replenishment could restore the site to pre -storm conditions which would also bring the alignment into compliance. EPI is requesting a meeting with DCM to review the compliance undertaken in December and January and to request appropriate measures such as beach bulldozing to bring the site to pre -storm conditions and thus into compliance with CRC directives. It is our opinion that with consideration of the information presented, a Notice of Violation would not be necessary nor appropriate. We look forward to your cooperation.
