Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program. We need to repair our pier as a result of damage from Hurricane Irene. I am not certain of the street address. The last permit that we received was to repair the pier as a result of damage from Hurricane Isabel. That permit was issued on 1 December 2003 and reflects the street address as 1712 Island Road. That permit number was 36712. In any event, the location of the property is, as set forth above, adjacent to and immediately east of Calico Jacks and located on Back Sound. I have enclosed with this letter a copy of a letter to me dated 1 December 2003 from Tere Barrett and a copy of the permit which was enclosed with that letter. Hurricane Irene took away most of the decking on our pier. The hurricane also took away the cross ties on the L-shaped platform at the end of the pier. Most of the other cross ties remained. However, I have been replacing some of them because of their age. My understanding is that I do not need a permit to replace the decking. However, because of the age and damage from previous hurricanes to the pilings at the end of the pier, I would like to be able to replace those pilings. The question arose in my mind whether I would need a permit to replace those pilings. Therefore, I contacted your office. My understanding was that I needed a permit in order to replace the pilings. I can make do, if necessary, with the existing pilings. However, if possible, I would like to be able to replace them. Therefore, I am applying for this permit. I have also enclosed with this letter nine photographs of the pier. These photographs were taken by me on 27 May 2012. The photograph with the timeframe of 08:54 was taken from the shoreline. Mr. Barry Guthrie I I June 2012 Page 2 The three photographs with the timeframes of 08:55 and 08:56 were taken from our neighbor's pier immediately to the east of our pier. The two photographs with the timeframe of 09:00 and 09:05 were taken from Calico Jacks' pier immediately to the west of our pier. The three photographs with the timeframe of 10:29 and 10:30 were taken from my boat west and south of the pier. The photo with the timeframe 10:29 shows the pilings that I would like to replace. These pilings are still useable. However, they have been in the water for a number of years and have suffered from the many storms that we have had. Therefore, if possible, I would like your permission to be able to replace these pilings. There are 12 pilings which I would like to replace. I have enclosed with this letter two diagrams which I have drawn. These diagrams are not to scale. Diagram I is the way the dock appeared before Irene and the way I would like for it to appear again. Diagram II shows the work that I would like to do at the end of the pier. I have drawn the pilings in red which I would like to replace. I have already replaced some decking at the beginning of the pier. I am in the process of replacing the decking out another distance of approximately 64 feet before I get to the pilings that I would like to be able to replace. The photo with the timestamp of 08:54 shows the decking that I have replaced. I am in the process of replacing the decking out the next eight set of pilings, approximately 64 feet. The remaining 40 feet to the end of the pier is the area with the pilings that I would like to replace and includes the L-shaped platform at the end. I will not do any piling replacements or work on the last 40 feet or the "L" portion until I hear from you. I do not intend to enlarge the pier from its original footprint. I do not intend to make the pier any longer than it presently is, and I do not intend to make the pier or the platform any wider. I intend to remain within the confines of the 1 December 2003 permit which I received as a result of damages from Isabel. As stated above, I have enclosed a copy of that permit. Please issue to me a permit which would enable me to replace the pilings and reconstruct the pier in its original footprint. In order to validate this permit, please sign all three (3) copies as indicated. Retain the white copy for your files and return the signed yellow and pink copies to us in the enclosed, self- addressed envelope. If the signed permit copies are not returned to this office before the initiation of development, you will be working without authorization and will be subject to a Notice of Violation and subsequent civil penalties.
