Garner. The proposed project is located on a canal off of Bogue Sound, at 451 Broad Creek Loop Road, in Newport, Carteret County, North Carolina. The Division has reviewed all your concerns and objections to the proposed project. After reviewing the proposal along with your objections, the Division has determined that the proposed development is in compliance with the rules of the Coastal Resources Commission in 15A NCAC 07H.1500 for excavation within estuarine waters of canals, channels, basins or ditches. Therefore, the Division issued CAMA General Permit #56851C to Mr. Garner on October 7, 2010 for the maintenance excavation of 553 yds3 of material. The excavation would occur more than 5' from the rip rap along your shoreline and would only be excavated to a final project depth of -3' below normal low water. I have enclosed a copy of the permit for your review along with a copy of the aforementioned rule. If you wish to contest our decision to issue this permit, you may file a request for a Third Party Hearing. The request for a hearing will be considered by the Chairman of the Coastal Resources Commission. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days after the disputed permit decision is made. Subject: RE: Friday Ms. Stryon, Based on measurements and discussion at our site visit today, we agree that the proposed canal dredging on Broad Creek Loop Road can proceed with the following modifications. The dredge footprint of the channel cannot be wider than 8 feet when in the vicinity of live oysters, where oysters are avoided on the east side of the canal for approximately 11 feet from the bulkhead and marsh on the west side has a buffer of 5 feet. Any live oysters found within that footprint must be relocated to the sides of the canal immediately outside the dredge footprint. DMF requests notification of when any oyster relocation will occur so that a representative can be onsite.
