The request to allow the replacement of two existing culverts adjacent to the bridge is consistent with the current rules and regulations of DCM and DWQ and has been approved. The new design will replace the old side ditch pipes (in their original locations) and be covered back to their original contours, slopes and seeded. The Division of Coastal Management (DCM) through a Memorandum of Understanding with the Division of Water Quality (DWQ) has reviewed your project proposal, determined that the project as proposed complies with the aforementioned regulations, and made a "no practical alternatives" determination per those regulations. Those activities covered by your Coastal Area Management Act (LAMA) permit have received Buffer authorization as long as the project is constructed in a manner that continues to meet all of the conditions listed below. Failure to comply with this Buffer Authorization shall subject the property owner & the party (contractor) performing the construction &/or land clearing to a civil penalty of up to $25,000 per day per violation. 1) All stormwater runoff shall be directed as sheetflow through stream buffers at non-erosive velocities, unless otherwise approved by this certification. 2) All riparian buffers impacted by the placement of temporary fill or clearing activities shall be restored to the preconstruction contours and re -vegetated. Maintained buffers shall be permanently re - vegetated with non -woody species by the end of the growing season following completion of construction. For the purpose of this condition, maintained buffer areas are defined as areas within the transportation corridor that will be subject to regular NCDOT maintenance activities including mowing. The area with non -maintained buffers shall be permanently re -vegetated with native woody species before the next growing season following completion of construction. 3) Pursuant to NCACI5A 2B .0233 & .0259, sediment and erosion control devices shall not be placed in Zone 1 of any Neuse or Tar -Pamlico Buffer without prior approval by NCDWQ. At this time, NCDWQ has approved no sediment and erosion control devices in Zone 1, outside of the approved project impacts, anywhere on this project. Moreover, sediment and erosion control devices shall be allowed in Zone 2 of the buffers provided that Zone 1 is not compromised and that discharge is released as diffuse flow. 4) Bridge deck drains shall not discharge directly into the stream. Stormwater shall be directed across the bridge and pre-treated through site -appropriate means (grassed swales, pre -formed scour holes, vegetated buffers, etc.) before entering the stream. The project name is B-4025, Beaufort 39,SR 1925, Idalia Road over Broomfield Swamp Creek in Beaufort County. The WBS Element Number is 33392.1.1 . The proposed scope of work is to replace the existing timber bridge at Station 15+00 —L- with a proposed 112.62 Feet Long by 27'-10" Clear Roadway Bridge. Due to the age and condition of the existing structure, The North Carolina Department of Transportation deemed it necessary to replace the existing structure. The existing pavement is 20' wide.The Telephone and Cable TV Lines will be relocated and installed by Directional Bore as shown on the plans. The lines will be placed at a depth of a minimum of 6'under the bottom of Broomfield Swamp Creek. The Launching and Receiving Pits are well away from the Riparian Buffer. The amount of impervious surface has been reduced as much as possible. There will be grass shoulders throughout the project that will filter runoff from the pavement and thus minimize water quality impacts. Slopes of vegetated roadside ditches are typically steeper than 3:1 but are consistent with the existing slopes. Flatter slopes were not used due to the additional wetland impacts that would be created. There will be 2 pipe replacements at Station 17+00,Left and Right of —L- that discharge into the creek, but the stormwater is treated by wattles at the inlet and outlet ends of these pipes. A proposed 24" x 36' CSP Cross -Line will be installed at Station 17+45 to convey stormwater. Wattles located near the inlet and outlet end of the pipe will treat stormwater. DIVISION TWO • P.O. Stephen From: Sutton, Michael W Sent: Thursday, March 18, 2010 4:26 PM To: Lane, Stephen Subject: RE: Beaufort Bridge 39 Good Afternoon Sir: This is in regard to inquiries for B-4025, Beaufort 39: The areas in the Buffer Zones on the North Side of the project are disturbed/impacted because past experience on projects very much like this one have required more area for staging than was originally anticipated. The proposed access road enters the Buffers and thus, requires that area for that proposed road to be constructed. Permitting this area now will minimize the number of future permit mods to be made, therefore eliminating confusion and possible construction delays. The stone on the existing soil access road will be removed from the Buffer and that portion of the existing road that is abandoned will be seeded and mulched, returning it to its native state. Grassed swales will used from Sta. 16+30 to Sta. 16+85,Lt and Rt. of -L-. No PAM will be used on the wattles on the outlet end of the proposed pipes. It looks like some of the area in the Buffer Zones on the North side of the project are being disturbed/impacted that could possibly be avoided. Could you please let me know why these areas are being impacted? Am I correct in understanding that DOT will be removing the existing rocked access path on the Northwest side of the road for which the DOT has applied to relocated to another area (also in the Buffer). Will grassed swales lead from the 24" CSPs on the North side of the project to the creek, and will this satisfy DWQYs requirement for stormwater treatment of 100' of grassed swale per acres of drainage area?
