Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

This letter is in response to your correspondence received by the Division of Coastal Management on
July 24, 2009 regarding your concerns about the proposed pier and dock construction by Mr. Louis W.
Sewell, III. The proposed project is located at 110 Adrian Lane near the mouth of Dennis Creek off the
AIWW in Swansboro, Onslow County, North Carolina.
The Division has reviewed your concerns and after project modifications including a re -aligning and
shortening of the proposed pier, we have determined that the development is in compliance with the rules of
the Coastal Resources Commission at 15A NCAC 07H.1200 and as such issued a permit to Mr. Sewell on
March 16, 2010. The "T"-shaped pier is permitted to a total length of 70' and includes a 50' X 8' platfonn.
have enclosed a copy of the permit as well as the above referenced statutes for your review.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party
Hearing. The request for a hearing will be considered by the Chairman of the Coastal Resources Commission.
The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days after the disputed permit decision is made. Please contact me or Barry

On July 23, 2009 1 received an adjacent riparian property owner statement from
wty ®CM
Louis W. Sewell III, owner of the property located at 110 Adrian Lane, Swansboro, NC, advising
me of a proposed dock to be built on the property adjacent to mine on 106 Adrian Lane. I have no
problem waiving the setback as the proposed sight is not within the 15' setback of my property.
What I do have a problem with is the proposed dock. The survey that was sent to
me does not show the channel that myself and a dozen or so other waterfront owners use to get
in and out of Dennis Creek. This channel would be blocked by this proposed dock. The survey
also does not show the ever expanding sandbar which currently would end somewhere within the
50' T at the end of the proposed dock. During the winter low tides the sandbar grows seagrass.
The historical usage of this property, in regards to docks, has always took into consideration the
Dennis Creek access. For over 50 years this property has had a 30' dock.
I strongly urge you to do an on site inspection and locate the proximity of the
sandbar and the Dennis Creek channel in relationship to the proposed dock.

It has been brought to our attention, that a Minor Development Permit to construct a 147 foot pier with an
attached 50 foot perpendicular pier has been applied for a property bordering the ICW and Dennis Creek at
110 Adrian Lane in Swansboro. Our home is located on Dennis Creek (104 Adrian Lane) which has a
restricted opening into the ICW.
While we welcome the investment in our area and wish the applicant much success and enjoyment from
the erection of such a pier, we would like to point out that the construction of this pier could severely limit
our access to the ICW from the creek and may eliminate it entirely during low tide intervals. Enclosed are
copies of photos depicting a sandbar which has formed at the junction of Dennis Creek and the ICW forcing
traffic exiting the creek to the left alongside and diagonally across the lot where this pier will be erected.
As you are aware, our investment in property bordering coastal waterways is understandably expensive
due to our ability to access the waterways and enjoy the natural beauty of the North Carolina coastal areas.
If egress to the waterway is prohibited then obviously the value of my and other residential property on
Dennis Creek will be financially catastrophic.
We kindly ask that you keep in mind our concern over the potential restriction of our access to the ICW
resulting from the granting of this permit without consideration to dredging that will need to be performed
across this sandbar to allow access. We are all aware of the cost, limited life span and difficulties in
obtaining dredging permits and are willing to discuss our options regarding the potential issues associated
with this pier permit prior to its approval.

This letter is in response to your correspondence received by the Division of Coastal Management on
August 24, 2009 regarding your concerns about the proposed pier and dock construction by Mr. Louis W.
Sewell, III. The proposed project is located at 110 Adrian Lane near the mouth of Dennis Creek off the
AIWW in Swansboro, Onslow County, North Carolina.
The Division has reviewed your concerns and after project modifications including a re -aligning and
shortening of the proposed pier, we have determined that the development is in compliance with the rules of
the Coastal Resources Commission at 15A NCAC 07H.1200 and as such issued a permit to Mr. Sewell on
March 16, 2010. The "T"-shaped pier is permitted to a total length of 70' and includes a 50' X 8' platform.
have enclosed a copy of the permit as well as the above referenced statutes for your review.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party
Hearing. The request for a hearing will be considered by the Chairman of the Coastal Resources Commission.
The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days after the disputed permit decision is made. Please contact me or Barry
