This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

RE: General Permit #11928A for Maintenance Dredging
Dear Mr. Ballance:
General Permit #11928A was issued to you on January 25, 1994 to authorize the
maintenance excavation of a sand shoal in the basin next to the Pilot House Restaurant in
Buxton, Dare County. A site inspection of the project area on March 4, 1994 revealed that a
spoil disposal dike had been pushed up in possible section "404" wetlands. In a phone
conversation with Mickey Sugg of the U.S. Army Corps of Engineers on March 14, 1994, he
confirmed that the spoil disposal dike had been constructed in "404" wetlands.
One of the conditions on your permit states that spoil material will be pumped to a
highground diked disposal area at the end of the basin. Since the diked disposal area was
constructed in wetlands, you have violated one of the conditions of your permit making your
permit -null and void at this time, You will be required to restore the impacted wetlands area
as directed by the Corps of Engineers. Mickey Sugg and I are planning to make a site visit to
your property on April 7, 1994 to look at the problem further. We will be contacting you to
set a specific time to meet you.
If you have any questions concerning this matter please contact me at this office. Keep
in mind that your permit is null and void at this time and until this matter is resolved.
