This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.
In issuing this permit the State of North Carolina certifies that
this project is consistent with the North Carolina Coastal
Management Program.

This is in reference to your request to modify CAMA General Permit
113102 which was issued to the Town on July 14, 1994 and authorizes
the construction of a pedestrian pier into Taylors Creek near the
NC Wildlife Commission boat ramp. According to your contractor,
you wish to extend the pier for an additional 16' into Taylors
Creek so that you may avoid an oyster rock.
Please be advised that CAMA General Permit #13102 is hereby refined
to allow for this extension. Please attach a copy of this letter
to your permit so that it may be made available to Department
personal when making routine monitoring inspections at the project
site.

RE: Denial of LAMA General Permit Request
Dear Mr. Martin:
After reviewing your request in conjunction with the development standards required by the Coastal Area Management
Act (CAMA), it is my determination that no permit may be granted for the project you have proposed.
This decision is based on my finding that your request violates N.C.G.S 113A-120(8) which requires that all applications
be denied which are inconsistent with CAMA guidelines. You have requested to construct a temporary erosion control structure
(sandbag bulkhead) on the oceanward side of South Bald Head Wynd, on Bald Head Island, in Brunswick County. On July 15,
1994, Emergency CAMA General Permit #12584-D was issued to the Village to install temporary sandbags along 90 LF. of
the South Bald Head Wynd right-of-way that qualifies as imminately threatened. You requested to install sandbags for
approximately 300 L.F. of the road right-of-way. Your request is inconsistent with 15A N.C.A.C. 7H.1705(a)(3) which states
that:
Shore -parallel temporary erosion control structures must not extend more than 20 feet past the end of the structure to
be protected. The erosion control structure also must not come closer than 15 feet to the applicant's side property lines
unless the application is part of a joint project with neighbors trying to protect similarly threatened structures or unless
the applicant has written permission from the affected property owner. The landward side of such temporary erosion
control structures shall not be located more than 20 feet seaward of the property to be protected.
Should you wish to appeal my decision to the Coastal Resources Commission or request a variance from that group,
please contact me so I can provide you with the proper forms and any other information you may require. Appeal notices must
be received by the Division of Coastal Management in Raleigh within 20 days of your receipt of this letter in order to be
considered.
