drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void. .
This permit must be on the project site and accessible to the iii permit officer's signature

Dear Captain Tardiff:
I would like to thank you for your letter dated March 22, 1993
regarding the requirement for a LAMA permit and its accompanying
fee for the replacement of bulkheading following the March 13, 1993
storm. The NC Division of Coastal Management is charged with
executing the NC Coastal Area Management Act which requires permits
for any development activity located in an Area of Environmental
Concern. The March 13, 1993 storm damaged and destroyed numerous
shoreline erosion control structures including bulkheads, rip rap,
jetties, groins, etc. The replacement of these structures requires
a permit under the Coastal Area Management Act. Under rules
adopted by the Coastal Resources Commission, there is no mechanism
by which replacement of these structures could be allowed without
first being authorized by the issuance of a CAMA permit. In 1991,
the Commission established a permit fee of $50 for the issuance of
a LAMA general permit. Currently, the Commission rules do not
allow for extraordinary circumstances which would allow this $50
fee to be waived.
The Division of Coastal Management is not a "revenue
collection" agency. We are a regulatory agency that must abide by
rules set by the Commission in administering the Coastal Area
Management Act. The Division of Coastal Management has issued over
150 CAMA permits for replacement of storm damaged structures
following the March 13, 1993 storm. Your concern has been the only
communicated concern raised regarding required permits and permit
fees. Be that as it may, at its last meeting, I requested that the
Coastal Resources Commission change its existing rules to allow
LAMA permits to be issued without the permit fee under emergency
situations. The Commission adopted my proposed amendment which
will be scheduled for public comment in the near future.

have caused at least a reexamination of the existing regulations
regarding certain permit fees. I encourage you to follow progress
of this issue over the next couple of Coastal Resources Commission
