This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

This letter is in response to your 24 August 1993 correspondence
referencing my 20 August 1993 letter and bulkhead construction on the Jack D.
Stevens' property across the canal south of your residence on Pungo Creek.
You were not renotified of the bulkhead alignment authorized for Mr.
Stevens at the time of permit issuance for the following reasons: the alignment
authorized at the time of permit issuance was a retreat from the alignment
initially discussed on the Stevens' property. In other words, the alignment
authorized was landward of initial discussions, it was further out of the
Estuarine Waters, Public Trust Area and navigable area of the manmade canal.
Standard operating procedures of the Division would not imply that any
renotification be necessary. Furthermore, bulkhead alignment was of no issue in
your signed statement of no objection in which you simply stated, "JACK STEVENS
HAS MY PERMISSION TO PUT DOWN A BULKHEAD ON HIS PROPERTY THAT JOINS MY PROPERTY.
I HAVE NO PERSONAL OBJECTIONS."
As stated in my 20 August 1993 correspondence, the Division of Coastal
Management does not have a policy regarding final disposition of existing
structures conditional to permit issuance.
