This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

Dear Mr. Rothrock:
The NC Division of Coastal Management has a received a copy of
your request for a variance from the Coastal Resources Commission
to allow you to place a sandbag erosion control structure waterward
of your septic system on lot 9, Seagull Subdivision, Currituck
County.
In order that your request may be handled as an expedited
variance request, we must agree on the facts that establish your
case. I have put together a first draft of facts and ask that you
review these as quickly as possible and relay any changes and/or
suggestions that you might have by phone to me. We must both agree
on these facts; the Coastal Resources Commission will be limited to
these facts in considering your request.
If we can agree quickly on these facts so that the remainder
of the variance packet can be assembled timely by DCM staff, then
your request may be heard before the Coastal Resources Commission
at its November 18-19 meeting in Kill Devil Hills.
Please read very carefully the attached list of stipulated
facts and call me so we can discuss these.

STIPULATED FACTS
1. The petitioner owns lots 8 and 9 in Seagull Subdivision
adjacent the Atlantic Ocean, north of Corolla in
Currituck County.
2. Currently, a single-family residential structure is
located on lot 8 with its associated ground -absorption
septic system located on lot 9.
3. The current long-term annual erosion rate applicable to
this property is 9 feet per year, making the small
structure setback 270 feet.
4. No dune or vegetation exists along the oceanfront of the
petitioner's property.
5. During storm events, waters of the Atlantic Ocean have
washed over the petitioner's property.
6. The Halloween Storm of 1991 washed out the petitioner's
septic system that was located at that time on lot 8.
7. In order to repair/replace his septic system, the
petitioner purchased lot 9 to his south. A new septic
system was constructed on lot 9 to service the
residential structure located on lot 8.
8. Significant erosion occurred to the petitioner's property
during the winter of 1992-1993.
9. On January 14, 1993 waters of the Atlantic Ocean were
located within 20' of the foundation pilings of the
petitioner's residential structure. This allowed the
petitioner's structure to be considered an imminently
threatened structure.
10. On February 16, 1993, the petitioner (Stephen Rothrock)
and his neighbor to the north, John Reid ( lot 7 ) were
given CAMA general permit 110296A (pursuant to NCAC
T15A:07H:1700) to place sandbags waterward of their
residential structures.
11. Consistent with North Carolina Administrative Code T15A:
07H.1705(a)(3), temporary sandbags were authorized to be
placed waterward of and within 20' of the residential
structures. No sandbags were authorized to be placed in
front of the septic system on lot 9.
12. Following the issuance of CAMA general permit 110296A,
the petitioner and Mr. Reid constructed their sandbag
erosion control structure as permitted.
13. On September 30, 1993, Stephen Rothrock applied for a
variance from the Coastal Resources Commission to allow
him to place sandbags waterward of his septic system
located on lot 9 serving the residential structure on lot
8.
