violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

Dear Ms. McHugh
The Fairfield Harbour Waterfront Committee, eight
members who all live on waterfront property, have reviewed
your denial letter for a dock permit on Lot #211 (Martian
Olstead). This Committee always reviews all dock
applications after CAMA approves them to insure that the
submission is in accordance with the more stringent Fairfield
Harbour POA rules.
Your concern was valid with the sketch that was
submitted. It was not to scale and certainly encroached upon
your Riparian rights. The Committee has redrawn the
•application to scale showing what is allowable within the
POA's rules and guidelines. The attached drawing shows the
Riparian lines for the requested dock permit and for the
adjacent lots on either side. Notice the inner circle. This
follows the 1/3 rule that is considered common water for all
lot owners to maneuver into or out of their docks. Since the
water culdesacs or coves as we call them here are a difficult
area, this committee's policy is to redraw all applications
and study several configurations. It is too bad that we don't
get the chance to do this before adjacent lot owners are
asked to give their permission. But to date that's the
process we're using when interfacing with the State of North
Carolina.
What we are recommending here is that the requested dock
on lot #211 be limited to 20' long by 4' wide. In addition
all tie poles must be within the requesting owner's Riparian
lines and within 2/3rds of the coves radius of 47' or 31.331.
Our Committee's charter is to protect all waterfront
owner's rights whether you are a resident or not and whether
you have built a house or not. On all waterfront lots it is a
State requirement that all docks and pilings(tie poles) must
be 15' from each property line. In the case of cove lots this
is impossible. If followed no one could have a dock or boat
on cove lots. Therefore in these cases we ask owners to sign
a waiver or release form to allow the dock and tie poles to
be less than 15' from the Riparian lines.
As every lot owner has the right to use the water within
his Riparian right lines, we cannot accept the premise that a
dock or boat will restrict a neighbors view. It is a fact
that waterfront owners shall be allowed to have docks and
pilings. The POA does not get involved with what type of boat
or size as long as the boat is within the Owner's Riparian
lines.
We hope that this clears up the situation for you, but
if you have any furthur questions as to waterfront rights
please do not hesitate to write or call us anytime.

authorizing the construction of a pier at his property on Gondolier Drive, in the Fairfield Harbor
community, near New Bern, in Craven County. This is to advise you that if you wish to appeal
this permit decision, you have twenty (20) days from the date of permit issuance to do so.
Please contact this office and we will be happy to send you the appropriate appeals form.
A copy of Mr. Olstead's permit is enclosed for your review. If you have any questions
