This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistentwith the North Carolina Coastal Management Program.

We have received your request to dredge the canal, as well as repair and extend your seawall at
the Carteret County property_ We agree to the following:
To grant you permission to apply for a CAMA permit to repair and extend your seawall
to prevent further erosion to your lot.
To f*rant you permission to apply for a CAMA permit to dredge the canal as allowed by
law, provided we incur no expense with the project, that _you be responsible for any and
all damages that may be associated from said dredging, and that w`ide will be held
harmless and blameless for any liability that may occur from said dredging. Further, no
spoils shall be placed on any property that is owned or controlled by members of the
Scarborough family, and that no equipment used during the dredging activities may be
located or used from the property owned or controlled by the Scarborough family.
Finally, the dredging of the canal at your expense will not impede or disallow the
Scarborough family from using the canal now, nor in the future.
To grant you permission to apply for a CAMA permit to install a boat lift adjacent to
your dock provided said boat lift complies with any and all applicable federal, state and
local regulations, as well as any recorded covenants on said property, nor impedes access `o
navigable waters within the canal.

form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign
both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of
this decision on your permit. You should also be aware that if another qualified party submits a valid objection to
the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise

This permit, issued on MARCH 3, 1994 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) -A silt curtain will be installed between the area to be excavated and the remainder of the canal.
It will be maintained until all excavation has been completed. To prevent sedimentation in
adjacent waters, 24 hours will be allowed to elapse between the time excavation is completed
,and the silt curtain is removed.
2) "The area to be excavated is modified to delete a small area waterward of adjacent property to
.-the south (see revised plan). Furthermore, no excavation may take place on land owned by
ianother without written permission of such owner.
3) "The top width of the excavation shall not exceed 30' at any point along its alignment.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1997
In issuing this permit, the State of North Carolina agrees
that your, project is consistent with the North Carolina
Coastal Management Program.

4) Excavation will not exceed three (3) feet below the elevation of mean low water (MLV).
5) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
6) -The activity will be conducted in such a manner as to prevent a significant increase in turbidity
outside the area of. construction or construction -related discharge. Increases such that the
turbidity in the waterbody is 25 NTUs or Iess are not considered significant.
Spoil Containment
7) Prior to beginning any excavation activities authorized by this permit, the size of the disposal
areas shall be modified in order to adequately contain the excavated materials generated from
this project.
8) All excavated materials will be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters.
Bulkhead Construction
9) The bulkhead will be positioned landward of any Sp alterniflora marsh. To prevent an
unintentional violation of this authorization, representatives of the N. C. Division of Coastal
Management and the Corps of Engineers will be available to stake the alignment prior to
construction.
10) No vegetated wetlands will be filled.
11) The bulkhead must be constructed prior to any baclfilling activities.
12) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through
the structure.
13) All fill material to be placed below the mean high water level will be confined behind the
permitted bulkhead.
