The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The DCM reviewed the application along with the pertinent rules of the Coastal Resources Commission in conjunction with your objections and determined that the project is consistent with the Commission's rules. Therefore, the DCM issued CAMA General Permit #48111-C to Francis and MR Willis on May 7, 2007, authorizing the boathouse as proposed. If you wish to appeal this permit decision, you must file a Third Party Hearing Request with the Director of the Division of Coastal Management, Mr. Charles S. Jones, Department of Environment and Natural Resources within 20 days of the permit decision. A copy must also be sent to the Attorney General's Office, Environmental Division. As mentioned, we have been informed by the contractor, Foley & Foley Contractors, that Mr. Williams, residing adjacent to our property, at 108 Bowline Road, is applying for a permit for the construction of a boathouse. We hereby go on record that we object to the construction of any boathouse for the following reasons: 1. It would obstruct our view of the deepwater canal and the wildlife preserve across the canal. 2. The construction of a boathouse will have a definite negative impact on our property value. This was confirmed by a major real estate agency here in New Bem and we can supply you with a letter stating this if you so wish. 3. A boathouse, extending 30 feet out into the canal, will most probably have a negative impact on the environment of the canal and the wildlife preserve across the canal. 4. A boathouse, extending 30 feet out into the already narrow canal, and with a height of about 12 feet, will obstruct the view of boat traffic on the canal, since there is a bend in the canal at that point. This would create a hazard to the boats going to or coming from the River Bend Marina. We have notified the Town of River Bend and have been informed that the matter of the construction of a boathouse along the Plantation Canal and wildlife preserve will be discussed and evaluated at the next Planning Board meeting. We would appreciate your consideration in this matter. Williams 108 Bowline Road River Bend, NC 28562 Dear Mr. Williams: N4AY �l 17IJW Morehead City ACM This letter is written to inform you of restrictions under the Town of River Bend's Floodplain Management Ordnance that relate to your boathouse project. Specifically, any structure constructed in the floodplain must meet standards specific to the floodplain and those that apply in the case of your boathouse project are: 1. This structure, which will be located over the water of the Plantation Canal, will not be permitted as a structure with enclosed walls. 2. The structure must be constructed in a manner that will withstand the hurricane force winds and the flood levels that are experienced during tide levels associated with hurricane events. 3. The customary use of this type of structure incorporates a boat lift which is typically powered by an electric motor. If your structure is to be equipped in this way, the electric motor must be located above elevation 11 feet and the electric service serving the structure must also be flood proofed (capable of being submerged) from the power source to the motor location.
